Should a Marine seeing that photo happen to recognize this fellow, a lesson in some of the finer points of the UCMJ and in the regulations concerning conduct while in uniform would be an unsurprising development in his career track.

This is a fake, and a poor one at that. The sign doesn't cast a shadow and the placement of the hands is unnatural. They would grasp a sign, not hold it up like a tray.
