Schiavo's Brother Pleads With Democrat

WASHINGTON (AP) - A House Democrat trying to stop legislation backed by Terri Schiavo's family turned down a request to reconsider his position from her brother when the two ran into each other Sunday in the House Press Gallery.

A little awkwardly, Bobby Schindler and Rep. James P. Moran, D-Va., shook hands. Schindler then launched into a passionate defense of the legislation. The bill would effectively take Schiavo's fate out of Florida state courts, where judges ordered the feeding tube removed on Friday, and allow Schiavo's parents to take their case to a federal judge.

As reporters and photographers gathered, he handed Moran a CD and urged him to consider footage of his sister.

``She's doing the best that she can trying to speak to my dad,'' in the footage, Schindler, a high school science teacher, told Moran. ``I urge you, in fact I am begging you to at least listen to these videos of my sister communicating with my father.''


``I am happy to take a look at that,'' Moran replied. ``But my greater concern is not with the immediate facts of this case as much as it is the precedent, of overruling the state courts, of politicizing a tragic family situation.''


The encounter took place after House GOP leaders were rebuffed by Democrats in their initial effort to rush the legislation through in the early afternoon. The House was returning later to consider the measure under less restrictive rules, aiming for a vote early Monday on the bill that was passed by the Senate late Sunday afternoon.


Family members believe that the footage and audio of Terri, 41, will convince opponents of the bill that she is not in a persistent vegetative state as her husband, Michael and several doctors say, but able to interact and emote.


Rep. Dave Weldon of Florida and Senate Majority Leader Bill Frist of Tennessee, both doctors and Republicans, said footage they have seen has convinced them that she is not in a vegetative state.


Schiavo suffered severe brain damage in 1990 when a chemical imbalance apparently brought on by an eating disorder caused her heart to stop beating for a few minutes. She can breathe on her own, but has relied on the feeding-and-hydration tube to keep her alive.


Court-appointed physicians testified her brain damage was so severe that there was no hope she would ever have any cognitive abilities.

I know Fox reported it was new audio tape, but I think it may have been a setup by Michael. It sounded exactly like the audio off the old video tape between Terri and her father.

We know that Michael is not above set-ups. Remember how he accused the Schindlers of making needle marks on Terri's arms, in January of 2004? He prohibited their visitations at that time, too.

Excerpts of a bill passed Sunday by the Senate and under consideration by the House of Representatives in the Terri Schiavo case:

"The United States District Court for the Middle District of Florida shall have jurisdiction to hear, determine, and render judgment on a suit or claim by or on behalf of Theresa Marie Schiavo for the alleged violation of any right of Theresa Marie Schiavo under the Constitution or laws of the United States relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life."

"Any parent of Theresa Marie Schiavo shall have standing to bring a suit under this act. The suit may be brought against any other person who was a party to State court proceedings relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain the life of Theresa Marie Schiavo, or who may act pursuant to a state court order authorizing or directing the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life.

"In such a suit, the District Court shall determine ... any claim of a violation of any right of Theresa Marie Schiavo within the scope of this act, notwithstanding any prior state court determination and regardless of whether such a claim has previously been raised, considered, or decided in state court proceedings. The District Court shall entertain and determine the suit without any delay or abstention in favor of state court proceedings, and regardless of whether remedies available in the state courts have been exhausted."

"After a determination of the merits of a suit brought under this act, the District Court shall issue such declaratory and injunctive relief as may be necessary to protect the rights of Theresa Marie Schiavo under the Constitution and laws of the United States relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life."

Could it also be that the governor won't use protective custody for fear of the Pinellas Co. establishment, not fear of MRS or George W. Greer in particular? He can exert extralegal authority, as other strong, decisive people have in the past. Theodore Roosevelt, for instance, used extralegal powers to end an anthracite strike on terms favorable to organized labor. HST used it against the steel industry, but he was stopped by the Supreme Court. Still Bush could buy Terri a few precious hours. Honestly, how could anyone survive 24 more hours in her condition.

I remember in 2003 how the legislators all had to flap their gums while Terri clung to life. So many of them gave long speeches about how difficult this was for them, and why they were voting as they did. Will they do the same today?

Yea Jeb, send in someone from the DCF with medical training, along with a few of your OWN armed guards.
They DONT have physically MOVE her.

All they have to do is check/monitor EVERY 'pain-med' injection for the next 12 hours and she will likely be saved.
