I'm sick of hearing Dems claim that Republican are "playing politics with what should be a family issue." Republicans are acting at the request of the family. They are responding to their constituents who care deeply about this issue.
I think it's about all we could expect of Governor Bush. Sadly, I think we're learning some lessons the hard way. The first one is that we have to be careful who we put forward, not just in terms of their beliefs, but in terms of their courage. The truth is Jeb could do something, but he could face hell from the State Senate. He could face hell from the liberals and even big brother. Remember, Roy Moore stood up to the judges and look what happened to him! I guess the thought is, "better a live coward than a dead hero."

Basically I guess the judge is above the law at least according to Jeb. He has stopped an agency from performing a legal duty that is required of them to do. It is sad when a judge can intimidate a Governor, a President and a state agency and have them stand by helpless while they commit state sanctioned murder.
Terri would have died several years if it weren't for Jeb's work. He's done his best.
Why doesn't Jeb take some members of Florida Law Enforcement and/or the National Guard with him and a MEDICAL TEAM, secure the premises and go to hospice, reinsert the tube and administer nourishment to Terri. Leave Law Enforcement both outside and inside hospice and outside and inside Terri's room. When her condition stabilizes, REMOVE her.

Well then Governor Bush you also have a duty to uphold the law when Judges violate it too. Why are you allowing Judge Greer and Michael to get away with refusing to give Terri water even by mouth? I believe Jeb Bush can intervene because Judge Greer has issued a clearly illegal order that no water or food can be given to Terri even by mouth. This is not just the removal of a feeding tube but this judge has denied a request by her parents to give her water and food naturally! No judge or court has this power and it does not take an attorney to figure this out. I defy anyone to find legal authorization, even in Florida law, for this order. Has anyone in Bush's office even challenged this specific aspect of Greer's order? If not then he hasn't done everything in his power.
As is stated in another thread on an article by a doctor (William Anderson) in the Weekly Standard titled "Terri's Last Chance" there is no medical, legal or moral reason to not attempt a trial of natural drinking. He argues all the outcomes of such a trial, even if it results in a quicker death, are better than refusing to allow her to attempt to take food and water on her own. Only Greer's order stops this and such an order is not within the power of a court to make or a guardian or a medical care facility to carry out.
Jeb and/or George Bush should blast Judge Greer out of the water on this illegal order and immediately give her water by mouth. This could allow time to dismiss Greer for violating her human rights by his order and overturn the guardian decision. I am afraid that Jeb's team has been focusing so much on reinserting the tube that they are neglecting to fight to give her the opportunity to take water and food on her own which evidently is her only chance now and is more humane in any event.

Gee I didn't know Dr. Kennedy was a legal expert on the Florida state constitution?
I don't know about anyone else but I am not comfortable with preachers in their pulpits demanding unconstitutional, illegal acts from elected officials.
Maybe its just me...

The court, in 1997 when Michael announced he was'engaged' should have immediately conducted a guardianship hearing and transfered Terri to State guardianship. Because of this failure, we are in the present situation.
Questions you might consider:
(1) Why did Michael choose to 'ignore' her wishes for nearly 7 years until 1997 when he announced he was'engaged' to Jodi Centonze and 'suddenly' remembered the conversation about life support with Terri from years before?
Michael Schiavo answer would probably rationalize that it took that long before he realized there was 'no hope for recovery...'
(2) However, the 1992 malpractice suit for $20 million was based on the premise/conclusion that Terri would NOT recover and she would require constant medical care for the remainder of her life estimated by Michael Shiavo and his laywers to be 51 years(which is the normal life expectancey)...Where were her WISHES at that time?
(3) The court, in 1997 when Michael announced he was'engaged' should have immediately conducted a guardianship hearing and transfered Terri to State guardianship, at a minimum because of the obvious conflict of interest on the part of Michael Shiavo.
The court system failed to act at that point, and that is a major factor on why we are at the point we are today.
Guardianship, by law and practice, is determined to be given to that person who is most heavily 'biased' in favor of the disabled person. Under most conditions this would be the spouse. However, most prudent courts, if during the guardianship period, the appointed guardian by circumstances or accident tilts the 'bias' away from the interest of the person so guarded, would conduct and immediate review, and at a minimum, transfer guardianship to the appropriate State agency.

And what has changed about this fact, in such a way that Governor Bush no longer believes it's imperative?
It can't be that a judge can legally stop an executive branch agency from perfoming its statutorally manadated duty. Not constitutionally, a judge can't, by my understanding.
If Jeb Bush has another understanding, then he needs to explain it.

This was Jeb Bush's OPPORTUNITY. I know he didn't think of it this way, but it was. If the court grants relief it will take the opportunity away and we'll NEVER KNOW whether he had the GUTTTTSSS to ignore the judiciary and DO THE RIGHT THING. That's what we want in a PRESIDENT.
The blame does not belong on Jeb Bush. He has done as much as he can and showed great moral courage .
The Schindlers have had lousy lawyering from the git go. They should have retained a top flight Constitutional lawyer like Alan Dershowitz or Davis Boise instead of a political idealogue .
