Senate Debate on Nominations Today the Senate resumes debate on the nomination of Texas Supreme Court Justice Priscilla Owen to the Fifth Circuit U.S. Court of Appeals. Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.

Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.

On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.

The GOP can win the WV senate seat in 2006, whether or not "Sheets" runs again...

Biden thinks the Republicans use the courts to get there agenda passed. I think the people votes are always overturned by the left wing judges never the other way. Gay rights in Nebraska and Mass, Immigration laws in California. I could go on forever. I know I shouldnt let these liars get to me but sometimes they does.

FIrst he says that the Supreme Court is conservative because 7 out of 9 were appointed by republicans, even though only 3 of the republican nominees are conservative.

Then a little bit later he said that the judges are independent, which is why the conservatives attack Kennedy even though he was appointed by a republican.


NOW he says the reason we want the courts is because WE CAN'T GET OUR AGENDA PASSED!!!!!

What has he been smoking. We pass and pass and pass, and then the courts throw out the laws we pass and make up their own.

Now Biden is complaining that the conservatives want the congress to actually VOTE for laws, rather than having regulators in the executive branch write them however they want, or having the judiciary make up the laws as they see fit.

The non-delegation argument is another good reason to support these judges.

And I think we all know what the 5th amendment says.

Now he'll attack Brown. OH, she has "attacked" the socialist agenda in the 30's. OK!!! But I don't believe Brown has ever argued that the Supreme Court should overturn the Social Security System.

He says "nobody would believe anything I say" -- he's right about that.

What would you like? Four years? From the time of Bush 2's first nomination? Fine. I'd say it was a failure of Republican Senators to prepare for the Democrat filibuster strategy.

(And I really don't care whether you take my point seriously or not. I think you're shooting for the "smartest person in the room" prize. It ain't happenin'.)
