Gary Bauer Calls Senate Judicial Deal a 'Sell Out'

Former Presidential Candidate Gary Bauer issued the following statement late Monday as news of the "travesty" to justice deal on stalled judicial nominees was released.

The President of American Values said: "This is a sad day for our nation. The desire of millions of Americans to restore balance to our federal courts has been thwarted behind closed doors by 14 senators. Only three of President Bush's appointees are guaranteed an up or down vote under this sell out.

"Under this agreement it is now more likely that radical social change will continue to be forced on the American people by liberal courts committed to same sex marriage, abortion on demand and hostility to religious expression. The Republicans who lent their names to this travesty have undercut their President as well as millions of their most loyal voters. Shame on them all."

Here's my take:


Extraordinary circumstances = pro life; pro gun ownership

extreme = a trail (however short) of conservative judicial opinions;

Acceptable attributes: pro abortion; gay rights and anti 2nd Amendment

We got at least 6. Reid was quoted as predicting that the 3 Michigan nominees to the sixth circuit would be easily approved. They've been stalled for years now by the blue slip exercised by Michigan's senators, so it's clear that these 3 Michigan nominees were an unspoken part of the deal.

So the 6th circuit court of appeals just became a strongly conservative court overnight.

No doubt about it. The RNC has received the last penny from me until they can demonstrate that party means something. I am holding the leadership to blame. Has anyone heard a single word from Mitch McConnell the Majority "Whip"? Somebody needs to whip his a$$ in the steps of the capitol building as an example.

keep in mind I am a liberal. You folks won on the filibuster. Not only do you have four judges in, but have the right to bring up the filibuster issue again.

Personally, I could care less about if they get rid of the filibuster itself, than I do about the dems selling
out by just passing on Priscilla Owen, Janice Rogers Brown, and William Pryor. Not even fighting for principle, win or lose says everything about the dems

you should celebrate, most of the liberals are not very happy by this deal

You need to reflect on this just a wee bit more.

The Reps got their candidates a vote; the Dems set a standard for "exceptional cirsumstances" which wipes out their litmus test; the Reps have the nuclear option and a good justification for using it if the Dems renege

The Repubs got a few of their candidates an up or down vote . . . maybe.  Others are left twisting in the wind..  Wait till the spinners spin just what constitutes exceptional circumstances.

Exceptional circumstances?  What is this standard you're talking about?

Thanks for posting the reactions on DU. Here's another:

This agreement is about a bunch of of senators wanting to avoid a showdown.

We can filibuster later; but if we do, they can go nuclear later.

Nothing has changed, except that they got their judges, and for now, the sky hasn't totally fallen in on us.

I'm angry, because I believe if it had come to a showdown, Frist would have lost OUTRIGHT.

I should say the 3 Michigan nominees other than Saad- he's a loser in this deal, but if Bush moves quickly he can get another conservative nominee to take his place in short order.

We need to move FAST- and any conservative judges who have been thinking of retiring need to do so now so we can nominate their replacements and get them confirmed.

This will prove to be a pretty good deal if Bush plays his cards right.

Furthermore, Lindsay said tonight to Chris Matthews, that the cabal of 14 will get together whenever Bush submits a nominee... so that "they" can decide for the other 86.

Now, THAT'S a power grab, and now, what damn use is the Senate's Judiciary Committee?

I heard Reid say the Michigan Judges would get a vote, but then I think he backed off on Saad. But then one of the "Michigan" judges is from Ohio and that appeals court is in Cincy so the details are a bit muddled.

Still if we get six or seven, no further filibusters until a couple of more Dims go down in reelection battles, ie Nelson and Nelson, and the GOP either later changes the judicial filibuster rule or filibusters the first slightly leftist nominee of the next Dim president, then this is a deal I can live with. It is just that it will be a long time before we know for sure unless the Dims try to not live up to the deal this Congress and the GOP has the guts to call them on it.

and the signatories of this agreement NEED TO BE MADE TO UNDERSTAND THEY HAVE PROMISED US TO SUPPORT SUCH A FILIBUSTER.

Have politicians ever been known to break a promise?

Republicans got nothing from this deal that they couldn't have gotten by cutting off the filibuster. This was no horse trade -- it was a give away.
