RULINGS ON MONDAY?

A look at the remaining cases of the Supreme Court's term:

TEN COMMANDMENTS: The constitutionality of Ten Commandments in public buildings and on government property, under the First Amendment's ban on an ''establishment'' of religion.

FILE SHARING: Whether the entertainment industry may sue technology manufacturers over consumers who use their products to steal music and movies online.

INTERNET ACCESS: A test of the tight control cable companies hold over high-speed Internet service in a case that will determine whether the industry must open up its lines to competitors.

DEATH PENALTY: A look at courts' flexibility to reopen cases, in an appeal that asks if an appeals court was wrong to order more study of a Tennessee Death Row inmate's claims.

RESTRAINING ORDERS: Whether police can be sued for how they enforce restraining orders.

I don't know what is wrong with SCOTUS.

"Kinder & gentler" GHWB, IMO. He had a shot at changing the balance but we got Souter instead.

SCOTUS refuses reporters appeal on CIA leak. They do not have right to testify on their sources.

Main problem is that Kennedy has gotten more liberal with time.

He used to be a swing voter....now mostly a liberal.

So, some of these cases we would have won in the past are lost, even with O'Conner on our side.

We really need a liberal to retire here, not a conservative.

I am so outraged....WHAT THE HECK DO WE DO?? Our Capital in Texas houses one of those monuments and now they will have to take it down...I AM SO PISSED, you have no idea!! WHAT DO WE DO?? I'M SICK OF THOSE BASTARDS ruling against the people in crucial rulings, and siding with the criminals(ACLU)!! Will this be the straw that broke the camels back?? C'MON folk what do we do?

But there were multiple issues in that case. The Kentucky courthouse displayed the 10 Commandments by themselves, and there was an injunction issued against that. Then, they took that display down and put up a display that included a number of other historical documents & symbols. The Supreme Court ruling is supposed to address both displays.

That's why I'm asking if they struck down just the first display of the 10 Commandments alone (which was already removed anyhow) or also the current display with the other symbols.

There are two rulings: One is the Texas monument, which is stand-alone on the capital grounds; the other is the Kentucky courthouse display, but the KY courthouse display involved multiple issues, which included the display alone and the display with other historical docs.

It would take a VERY concerted effort, but we ignore SCOTUS, remove any electable government official that pays them heed, and set up nullification committees in the several states to determine the propriety of federal laws (as Jefferson and Madison envisioned).

The Supreme Court on Monday turned aside pleas by two reporters and a magazine urging the Justices to create, for the first time, a right not to be forced to reveal to the government their confidential news sources. The action means that, at least for the time being, the Constitution and federal common law do not recognize a “reporter’s privilege” of confidentiality. (The Court denied review in Miller v. U.S., 04-1507, Cooper and Time Magazine v. U.S., 04-1508.)

Not to be contrary, but I am glad they voted 5-4 to strike it down. Let W. and Republicans everywhere get really pissed off about this. Let them smell the dog crap the liberals have been throwing at them for years. Until they want to puke. Until the smell seeps into their pores and cannot be washed away. Until they FINALLY say That's IT. Then maybe we can get somewhere. Perhaps this is the turning point.

I wonder if the counties can subdivide-out a 10' x 10' parcel, sell it to a private or group of private individuals and them place the 10C displays on the "private parcel"?

This is not good. They ruled against the one that included OTHER monuments.

I at least expected them to uphold that one. I am rather stunned....
