The Phrase "Roe is settled law" means far less than it implies.


Right now, Today, Roe is settled law. That doesnt mean however, should a Different Case, with different facts come before the court that an analagous case wouldnt be decided differently.

the "Roe is Settled Law" is one of the undignified shibboleths that conservative nominees must put up with in the name of duty.

No More, No less.

This is an excellent analysis, firmly based in the process that chipped away at Plessy v. Ferguson (the segregation case) for decades in multiple decisions, before the Court finally overruled it in Brown v. Board of Education.

People who want everything, now, just do not understand the politics not just of the Court, but of the Congress, the Presidency, all the way down to electing a Dogcatcher in Dover, Delaware.

If Clement gets on the Court and votes to uphold Roe, I will have to concede that the plan to vote Republican to stop abortion has failed. And that means I won't be voting Republican again.

That makes millions of us. It would be counterproductive for pro-lifers to vote Republican if Bush breaks his promise on this issue. It would waste of time, money and effort.

The Clement talk is giving me a case of schizophrenic paranoia, a malady common among conservative Republicans and sometimes referred to as "Souter's Disease."

Good Oliver – We’re getting the best of all worlds … a solid conservative who presents a likable, non-threatening image. Bush is no fool. He has no doubt run this pick by key pro-lifers and gotten the go ahead. Her confirmation is practically a done deal, which means Bush can save the fireworks for replacing Rehnquist and/or Stevens.

Bad Oliver – The fact that we’re even having to discuss whether she is conservative enough means she is the wrong person. This is O’Connor all over again … “She’ll be fine, Reagan wouldn’t have picked her if she wasn’t conservative, etc., etc.” She was highly recommended for the Appeals Court by Breaux and Landrieu for crying out loud.

How about Garza, please?

I think you have posted some of the most reasoned thought on this thread - Bush is clear in his thinking about these matters and his prior picks at the other levels have been genius. I've read other things about Clement that tell me he knows more about her than the average joe, too - her "maritime law" experience actually translates to oil rigs in the gulf coast and she's apparently well known in Texas circles. She (Clement) also has other ties to the Bush clan - the CONSERVATIVE circles close to W, not the elder's - and they give her top credentials.

Yes. Harold Carswell may have been the worst nominee never to make it to SCOTUS. Believe he was later arrested on a morals charge in Florida.
