Dear davidosborne,

I thought of that, the use of the recess appointment.

However, in this case, I think it would just provide ammunition for the folks who will try to gun down Judge Alito's nomination. It would be the sort of action used by at least the Dammocrap members of the Gang of 14 to hold fast to a filibuster. It might even make RINO squishies back down from the constitutional option to kill the filibuster.

I really don't like having to wait until January 9, but in this case, discretion may be the better part of valor.

I don't understand why anyone wants a recess appointment for Alito. His term would last only until the next Congress sits, just about 14 months. It will disrupt Alito's life for that period if he's not confirmed afterwards. That is not fair to him. I wouldn't take the job under those terms.

It's better to fight the dems in the Senate and hope they'll force the constitutional option. If the constitutional option is forced, it'll result in the end of filibusters of judges. If worded right, it could end the filibusters of any constitutional appointments the President makes that require the Senate's advice and consent. Less not lose our gonads and wimp out on this. Fight it tooth and nail.

What would a recess appointment do? Wouldn't he have to standbefore the Senate again at the nextCongressional session? Can they do that on a SC appointment?
