WASHINGTON - A group of centrist senators who halted a previous filibuster fight is making plans for Supreme Court nominee Samuel Alito, but at least two of the group's Republicans say their decision is already made: no filibuster. ADVERTISEMENT
"I don't believe that, with all sincerity, I could let that happen," Sen. Lindsey Graham (news, bio, voting record), R-S.C., a member of the so-called Gang of 14, said after meeting with the federal appeals court judge whom President Bush nominated to replace retiring Justice Sandra Day O'Connor.
Graham and Sen. Mike DeWine (news, bio, voting record), R-Ohio, were taking their anti-filibuster message to the other Senate centrists at a meeting Thursday. But the group's Democrats were urging them to withhold judgment, saying Alito has been the nominee only since Monday.
The defection of even two members of the group, which decided earlier in the year to support filibusters only in "extraordinary circumstances," would virtually ensure that Senate Majority Leader Bill Frist, R-Tenn., would win a filibuster showdown.

HEARING START JAN 9th.... Call White House, and ask President Bush to use RECESS APPOINTMENT for Judge Alito..
Dear davidosborne,
I thought of that, the use of the recess appointment.
However, in this case, I think it would just provide ammunition for the folks who will try to gun down Judge Alito's nomination. It would be the sort of action used by at least the Dammocrap members of the Gang of 14 to hold fast to a filibuster. It might even make RINO squishies back down from the constitutional option to kill the filibuster.
I really don't like having to wait until January 9, but in this case, discretion may be the better part of valor.

Thank you, David, for posting back with that.
With FReepers like you on board, this is a great place.
I will believe it after I see it.
I would not believe any of the 7 on their oath.
It's better to fight the dems in the Senate and hope they'll force the constitutional option. If the constitutional option is forced, it'll result in the end of filibusters of judges. If worded right, it could end the filibusters of any constitutional appointments the President makes that require the Senate's advice and consent. Less not lose our gonads and wimp out on this. Fight it tooth and nail.

What would a recess appointment do? Wouldn't he have to standbefore the Senate again at the nextCongressional session? Can they do that on a SC appointment?
