NRA to File Lawsuit Challenging San Francisco Gun Ban

Fairfax, VA - Even with opposition from San Francisco law enforcement and major media outlets, Proposition H -- a measure banning the lawful possession, sale and manufacture of handguns and ammunition within city limits -- passed yesterday. The National Rifle Association (NRA) will file a lawsuit challenging this severe gun ban.

NRA Executive Vice President Wayne LaPierre stated, “We are disappointed, but this fight is just beginning. Lawful residents of San Francisco are being stripped of their freedom because of an illegal measure that defies common sense. We will fight this outrageous assault on the rights of law-abiding San Franciscans and I believe that we will prevail.”

Many San Francisco residents who initially supported the ban changed their opinion after NRA and local volunteers began voter education efforts throughout the city. The campaign received an additional boost when the San Francisco Police Officers Association condemned the gun ban, declaring it would "nullify the personal choice of city residents to lawfully possess a handgun for self-defense purposes.” Major San Francisco newspapers also voiced opposition to Proposition H.

In response to the passage of this proposition, NRA will lead a coalition of organizations to immediately file a lawsuit against this illegal ban in San Francisco. Proposition H, in addition to violating federal guarantees, also violates various California state laws and is therefore preempted.

Chris W. Cox, NRA’s chief lobbyist, concluded, “This is a hollow victory for the gun control lobby because this scheme is in clear violation of California law. We will file suit and fight this to the highest courts in the country until good sense prevails once again in San Francisco.”

you can forget the CA courts and the 9th circuit. this will have to go all the way to the SCOTUS. I wonder, is it worth risking taking this case to the SCOTUS, just for San Francisco? if the SCOTUS upheld this, that would be trouble for 2nd amendment rights everywhere.

I think it will fail pretty quick...because it has been overturned twice already....even the 9th jerkit court of schliemiels cant overturn that much case law.

I was just over at DU checking them out. (I know, it's hard work, but someone has to do it!)

They think this is a bad law. Oh, a few think guns are just evil, but by and large, they don't think people should turn in their guns.

I went over there to check on how they defended the CA propositions. Most of the talk is how they hate Arnold, not on the merit of the propositions themselves. It's hard to believe in CA:

People don't want to know when their little kids are escorted to an abortion clinic

Don't want control of their union dues. (Go ahead spend my money on anything you want - I don't care)

Don't care about how much money the legislature spends (hey, we got plenty!)

Don't want the ability to fire incompetant teachers.

I did see some of the underage notification arguements because they felt it was part of the "slippery slope" but that was it. I guess they have to have a daughter devastated by a bad abortion to understnnd.

By the way, I know someone who had an abortion at 16 without parental consent. This destroyed her emotionally so severely she turned to the occult, and eventually became a solid, fundamentalist Republican. She always said to me, "How could they let me do that? Why didn't they tell me what I was really doing.?" She still mourns that child, and now has 8 children - all being raised conservative Christians.

San Francisco: we can pull abortion "rights" and gay marriage "rights" out of thin air, but we can't find the Second Amendment anywhere in the U.S. Constitution! Now give us some money, you filthy misogynist homophobes!!

Frankly, I don't have a problem with a locatlity enacting its own gun laws. I'm of the opinion that the Bill of Rights applies only to the Federal Government and that the expansion through the 14th amendment is erroneous.

Media may have opposed it but the way they report gang banger on gang banger crime they make it seem that "guns-are-bad".....

Frankly, I don't have a problem with a locatlity enacting its own gun laws.

The only problem with that idea is that CA state law preempts local regulations that exceed the requirements of state law.

The way the media portrayed the props (and the way that Communist union money spewed out disinfo commercials) your basic average dumbsh#% went to the polls yesterday believing:
1. If we required parental notification for abortions there would suddenly be thousands .... scratch that, millions... of back alley abortions done on teens whose parents were crack dealers and would have killed them if they mentioned they were preggers. Hey, "Cider House Rules".... great film!
2. If we made public employee unions respect the Beck Decision, all of the sudden, all da poh widdo nursies and firemen would be working 100 hour weeks for 1/2 pay, with Arnie shooting at them with an EEEEEEeeevil .50 cal rifle! Oh, the humanity! :(
3. Arnie is out to steal bake sale money from your neighborhood school and is a meanie.

Etc. I am not joking. Even all the MBAs living on my road were bought into this clap trap!
