Mother Sentenced to Four Years in Death of Daughter's Rapist

MARYVILLE, Tenn. A mother charged in the shooting death of a man she said raped her young daughter was sentenced to four years in prison today.

Authorities say Kimberly Cunningham must serve nearly a third of the sentence before being eligible for parole, The Knoxville News Sentinel reports.

Her attorney Bruce Poston told Blount County Circuit Court Judge D. Kelly Thomas that he would appeal the sentence.

In October Cunningham was found guilty of voluntary manslaughter in the death of Coy Hundley, her daughter's uncle.

Cunningham was tried on a charge of first-degree murder in April in the case, but the jury acquitted her of that charge and deadlocked on all lesser charges.

Cunningham has served about two months in jail since the October 7th 2003 killing and Poston said that would be deducted from her sentence.

I kind of wonder if the mom could have possibly been abused herself earlier in her life? Not by this man of course but someone else? In a way it almost sounds like a PTSS related response. If that was the case a lot of anger could come out from the flash back especially if it had been repressed and suddenly brought back to conscious or subconscious memory. In some cases the event lays dormant for years until something triggers the memory. It can be something as simple as the way someone says something to them.

I think they're by far the most amazing and infinitely fascinating things God ever created and I'm tickled silly that I lucked out and was born female.

I could sit and watch my hubby weld or fabricate metal for hours and not be bored.

I can listen to men talk amongst themselves with rapturous delight...:)

Either living in Oblivious Land or *not* living up to his infamous bellicose vows that he'd kill anyone who ever harmed me.

That's a whole can of disappointment/disillusionment worms right there because I was a daddy's girl.

Most likely my mom talked him out of whatever he *might* have been thinking of doing, if he did indeed think of doing anything.

*shrug*
I still love them.

I just don't particularly believe in them any more.

In their hearts, I think they know so I don't try to make them feel worse about it.

They have to work out their own part in it themselves, just like I do.

Consider women in general.

Most murders are committed by men.

Women are conditioned to sublimate anger and avoid violence.

It's in our societal nature to be non-violent and non-aggressive, really.

It's highly unusual to hear of a woman just up gunning somebody down.

Even crimes of passion that end in murder are more likely to be done by men.

[yes, I know that sounds sexist but I don't mean it to. men hunters; women nurturers]...;)

The most common female response is to gather up the child and flee from danger.

This woman acted out of character for her sex, historically speaking.

That alone makes me wonder if there's a huge backstory we're not hearing.

That's why it sounds like a PTSS reaction. I know one person about 4'10" who sent a husband flying across a room when enough was enough. There are are cases on record where women have killed their abusers in their sleep as well. The backstory though would not be admissable in her defense likely the same as any other offenses the man may have done would not be either. The daughter in this case was harmed three times by the uncle the last being losing her mother to jail.

I'm really surprised they got any type of jury conviction on her really. But there are some overzealous DA's in our area including federal ones who go after grandpa's for horse trading fire arms.

They'll hang you for that around these parts.

The VA trader ad paper is *full* of "great deals" on private sale guns.
Everytime I look at the ads, I can just picture a BATF agent waiting somewhere for some poor sap to show up with cash in hand.

[VA & WV are not far from here and the VA Trader is sold in local 7-11 type stores]

What get's me is they can manage to convict her but one county away they have been trying for over a decade actually closer to twenty years I think to put a man called Zoo Man Huskey away. He is a convicted serial rapist who took his victims {some were hookers} to a local zoo whe he had worked and did his deed.

This man has been afforded trial after trail and will likely go free. His mental state has been the basis of appeals it seems. In the meantime we the taxpayers have spent untold money for his lawyers who are of course the best defense lawyers in town.

In the Knoxville area the Feds have been hitting sellers in local flea markets who may have a shot gun or two at a flea market in their truck as well as adds in small time bargain papers. These are men in their 60's and older retired just making a few extra bucks. All of the sudden the feds see them as big time risk. They are not gun runners by any means.

That's in my county and where I usually shop. I live 15 miles or so east of Oak Ridge and down wind IOW ground zero :>{ Our DA has no ambition to prosecute violent crimes if I can find the article tomorrow I'll mail you a real sick one that got off. It was a real weird one. As well Meth is a problem here also. Same faces every few weeks of the same cookers in the paper. A local Constable was recently chewed out by our sheriff for foot pursuit & attempted arrest of a wanted man while helping a car dealer do a repossession. The sheriff didn't like competition it seems. Yea things get weird in these parts.

I remember seeing a case kind of similiar to this in Louisana. They caught the father ON CAMERA blowing the brains out of the perv who had abducted and molested his son. Walked right up to a phalanx of sheriffs escorting this creep to jail and shot him in the head. The tape was both gruesome and graphic.

He was acquitted of murder charges.
