Day 3: Questioning Continues

This morning, Round 1 concludes with Senators on the Judiciary Cmte. who did not question nominee Alito yesterday. During Round 2, questioning is limited to 20 minutes for each of the eight- een senators. Chairman Arlen Specter (R-PA) leads off, followed by the others, alternating by party in order of seniority.

I'm going to do some stuff around the house; I just cannot take even the sound of Schumer's voice. He isn't really asking or saying anything but trying to insinuate that he has something terribly important to ask Alito.

FOX is the worst news show out there ... except for all the rest of them. :-)

Which is not to say that Fox is perfect, just to say it is better then anything else out there. Still rely far too much on AP for background and filler. AP poisons their info well. They would be better off partnering with the better Bloggers and cut lose from AP. AP is basically a DNC run front group. Their complete lack of anything approaching balance poisons Fox News information well.

Why would Graham care if people know he helped Alito prepare for the hearing? So what.

I don't think that he[Graham] necessarily does. But I am wondering why Finegold, the opposition, cares who was involved in the process. I can't imagine that it is just harmless curiosity; can you? Graham didn't bring it up in his just ended question period, so that indicates that it is not a burning issue for him.

Against Graham, the argument (lame it is) goes like this ...

Coaching a judicial nominee behind-the-scenes is not the proper role for a Judiciary Committee member who must subsequently sit in judgment on that nominee. Indeed, it could be a violation of the ethical duties of a senator. Here's what Senate Rule 37 (Conflicts of Interest) in the Senate Ethics Manual says:

"No Member, officer, or employee shall engage in any outside business or professional activity or employment for compensation which is inconsistent or in conflict with the conscientious performance of official duties.'' ... The Committee has interpreted this paragraph to prohibit compensated employment or uncompensated positions on boards, commissions, or advisory councils where such service could create a conflict with an individual's Senate duties due to appropriation, oversight, authorization, or legislative jurisdiction as a result of Senate duties.

The unspoken argument is that Alito will not be idependent when matters involving exexutive prerogative get to SCOTUS, e.g., FISA/NSA, detention of enemy combatants.
