MASTER THREAD: FReeper Activism -- reports of turning in employers of illegal aliens
U.S. Border Control ^ | 3-28-06 | dfu

Posted on 03/28/2006 1:01:32 PM PST by doug from upland

THE IDEA STARTED ON THIS THREAD.

U.S. BORDER CONTROL
Turn in illegal aliens

We are hearing that reports of employers using illegal aliens or instances of illegal aliens engaged in criminal activity, have been responded to quickly by the new agency. Please note that it is unlikely that ICE will take any action against an illegal alien that is not employed illegally or engaged in some other sort of illegal activity.

The TOLL FREE number to report ILLEGAL aliens or those employing ILLEGAL aliens to ICE is: 866-347-2423

How it works:

You are not required to provide your identity to ICE.  All that is necessary to request an investigation by ICE is mere suspicion of any activity by ILLEGAL aliens.

ICE and the IRS are especially interested in "visiting" those businesses that employ ILLEGALS "off the books" to avoid the payment of payroll taxes.

Small and large businesses are equally notorious in the hiring of ILLEGAL aliens to avoid paying fair wages to its workers and to criminally evade the collection and payment of payroll taxes.

We are interested in getting current information regarding how helpful or unhelpful the new agency has been in taking your information and following up on your complaint, so please drop us an email to keep us current.

===========================

===========================

FReepers, here is a chance to make a difference in this battle. The only thing that will stop the invasion is stopping the employers who hire illegal aliens.

Please use this thread to give us reports of what you are doing. We need to develop a list of those businesses who can prove that they do not hire illegal aliens. If, for instance, you have spoken with someone at a certain restaurant and can determine that the restaurant does not hire illegal aliens, let us know about it. Those in the area need to partronize that restaurant. Positive publicity needs to be generated for them for being good Americans.

If you have evidence (perhaps including photos) of a business that is hiring illegals, report it to the number above and give us a report. Please do your homework on this. Make sure you get it right.

This may or may not have a significant impact, but we can't just sit here and watch our nation and culture being destroyed. If we can do this enough times around the country and make sure we get publicity, we have the potential to do something really important here.

Who is going to be first?

I bet that radical illegal organizations would threaten anyone who tried to give such a designation. They would certainly threaten any business that displayed such a sign.

Home loans for illegal aliens?!

TOWNHALL.COM
By Michelle Malkin
December 29, 2003

The American dream of home ownership, complete with the white picket fence, is alive and well for those who break our laws and break down our fences to get in.

Last week, The Washington Post published a rosy front-page tale headlined, "Illegal Immigrants Buy Into Homeowning Dream." The article detailed how illegal aliens in the Washington, D.C., area are successfully hooking up with cunning mortgage brokers and complicit lenders to secure home loans. Despite federal laws making it illegal to violate the borders, overstay visas, and recruit, harbor and encourage illegal aliens, the Post notes that the illegal alien home loan schemes are "legal."

Here we are, nearly two years after the September 11 terrorist attacks underscored the need for consistent immigration law enforcement, and the lesson continues to be ignored in the nation's capital.

The Post's heart-warming story began:

"Gerardo Cabrera fell in love with the house immediately. There was the bay window in the living room, the fireplace in the den, and -- most enchanting to a man raised amid the concrete of Mexico City -- the woods in the back yard. And so the auto mechanic and his wife, a secretary, decided to pay $200,000 for their own piece of suburban Gaithersburg, a classic tale of immigrants achieving the American dream. Except for one detail: At the time, they were in the United States illegally."

While law-abiding homebuyers must supply airtight proof of identity, legal residence and a Social Security number to lenders, illegal alien purchasers such as Cabrera (a visa overstayer who recently received a green card) need only supply a "taxpayer identification number" (TIN) issued by the Internal Revenue Service. No criminal background check is required before applying for a TIN, which many banks now accept from illegal alien customers as a primary form of identification.

Cabrera's broker, Alma Preciado of Metropolitan Financial Services in Silver Spring, told the Post that about 10 percent of her mainly Latino clientele qualify for home loans using a TIN instead of a Social Security number. > That's just the tip of the illegal alien homeowners' iceberg. The Post failed to note that Federal Housing Administration-approved loans through the U.S. Department of Housing and Urban Development do not require lenders to obtain proof of citizenship or legal permanent residence. These FHA/HUD programs, primarily targeting minorities and first-time homebuyers, are federally insured and require minimal down payments.

A 25-year veteran of the mortgage industry in California confided to me recently: "It boggles the mind to think how many illegal aliens are homeowners in this country thanks to these programs, all fully insured by our government. Because of fear of lawsuits for discrimination I can also tell you that a lender may have a borrower who speaks little or no English who claims to be either a citizen or resident alien and it will not be questioned nor any proof required. Since FHA does not require any such documentation, a lender cannot cite their regulations as a basis for the request as they can on conventional loans."

Another easy avenue to home ownership is through the use of bogus Social Security cards. Moneylenders have no access to a verification system to check Social Security numbers before approving loans. A Department of Homeland Security investigator informs me that an ongoing federal probe of FHA/HUD-backed loans found that "a staggering number were approved to persons with false Social Security numbers." The Denver metro area alone accounted for 20,000 to 40,000 of the FHA-approved loans for suspected illegal aliens. "Even if a small percentage of the loans were foreclosed, HUD could be bankrupted," the homeland security official said.

A spokeswoman for the U.S. General Accounting Office told me this week that the agency's office of special investigations plans to report on the results of the probe later this fall. But "considering the size of Los Angeles, New York, Chicago, Houston, and other large cities throughout the United States known to be inundated with illegal aliens," says my source, "I don't think the federal government is willing to expose this problem for financial reasons as well as for fear of political repercussions."

America: Still the world's home sweet illegal alien home.

I certainly appreciate your dilemma. Unfortunately, the problem will continue and worsen because of these economic traps.

The Social Security Number Verification Service (SSNVS) allows employers to match their record of employee names and Social Security numbers with Social Security records before preparing and submitting Forms W-2. Making sure names and Social Security numbers on the W-2 match our records is important because unmatched records can result in additional processing costs for you and uncredited earnings for your employees. Uncredited earnings can affect future eligibility to (and amounts paid under) Social Security's retirement, disability and survivors program.silver ball When you can use SSNVS

Employers can verify the names and Social Security numbers of employees only after they are hired. It cannot be used as part of the pre-hiring process. silver ball How to register to use SSNVS

  1. Employers must register for a PIN and password at Business Services Online at www.socialsecurity.gov/bso/bsowelcome.htm.
  2. Social Security will send an activation code in the mail.
  3. Use the activation code, PIN and password at the Business Services Online site to begin using SSNVS.

NOTE: For more detailed instructions on registering and/or using SSNVS, get a copy of the SSNVS handbook at www.socialsecurity.gov/employer/ssnv.htm.silver ball How to use SSNVS

  1. Go to the Business Services Online website and log in.
  2. Choose Social Security Number Verification Service.
  3. You have two options:
    • Direct keying of up to 10 names/Social Security numbers onto Social Security's website with immediate results; and
    • Upload a file with up to 250,000 names/Social Security numbers with next business day results
  4. You will receive a response of all names/Social Security numbers that do not match Social Security's records.
silver ball Restrictions on using SSNVS

  • Do not use SSNVS before hiring an employee.

--You may not verify someone's name and Social Security number until after you have offered him or her a job.

--Social Security will review usage of SSNVS to ensure that employers are using it for the proper purposes.

  • Do not use SSNVS to take punitive action against an employee whose name and Social Security number do not match Social Security's records.

--A mismatch does not imply that you or the employee intentionally provided incorrect information.

--A mismatch does not make any statement about an employee's immigration status and is not a basis, in and of itself, for taking any adverse action against an employee. Doing so could subject you to anti-discrimination or labor law sanctions.

silver ball What to do if a name and Social Security number do not match

  • Make sure you did not make a typographical error.
  • You may ask to see the employee's Social Security card to ensure you have the correct information.
  • If you cannot resolve the error, then ask your employee to contact the local Social Security office.
  • You should have a consistent company policy and treat all employees the same.
silver ball Can third parties use SSNVS?

If you are a tax preparer, accountant, payroll agent, payroll service or you process Form W-2 on another company's Employer Identification Number (EIN), you can verify names and Social Security numbers on behalf of your clients, but only for wage reporting purposes. You only need one PIN (even if you represent more than one company).silver ball If you need further help

HERE IS HOW IT WORKS TO VERIFY A SOCIAL SECURITY NUMBER

Call the Employer Reporting Service Center at 1-800-772-6270.

They will ask your employer ID number. With that, they are able to check the system for you. Before you can check, you have to have made an offer of employment. You give the info on the SS card. They will verify when the original application was made and verify the name, date, and gender. They will tell you if the info matches. If not, it is phony.

As we make calls, we should be demanding that the employer verify the SS numbers of his employees or we will not patronize his business.

I would like to take the opportunity to criticize Sidley Austin Brown & Wood. Alas, I cannot. I have been sued by them and they have an injunction placed on me that prevents me from discussing them.

Around So. Ca, all you need to do is go to any U-haul rental, Home Depot, or even any restaurant. Illegal Aliens abound. That is why the number is way higher than 11 million.

The govt has been throwing that 11 million # out for over 15 years...

Millions come here every year. The number is easily 3 times that.

Sidley Austin Brown & Wood Leads Trial Team in Tyson Foods Victory

3/31/2003

Federal jury swiftly acquits national food processor of all INS charges over undocumented workers

After only five hours of deliberation, a federal jury acquitted Tyson Foods and three of its managers of conspiring to bring illegal immigrants from Latin America to work in its food processing plants. Tyson’s legal team, led by Sidley Austin Brown & Wood’s Thomas C. Green and Mark D. Hopson, dashed the government’s attempt to invoke a rarely used forfeiture claim to seize millions of dollars in company profits.

Tyson was charged in a 36-count indictment in December 2001 with cultivating a corporate culture that condoned the hiring of undocumented immigrant workers. The indictments stemmed from an undercover investigation in which two U.S. Border Patrol agents posing as smugglers transported 154 immigrants with fraudulent documents to six Tyson plants. A day before closing arguments were presented, the judge dismissed 24 of the 36 charges.

"Tyson Foods was the absolute wrong test case for this," Mark Hopson told The New York Times. "Tyson was in the one percent of employers who volunteered to go on a computerized identification system checking system. The company was cooperating with the government every time there was the slightest wrinkle or knowledge of a hiring problem."

The jury also acquitted Keith Snyder, who managed Tyson’s plant in Noel, Missouri, of one count of conspiracy; and Robert Hash, a divisional vice president, of seven charges including conspiracy and fraudulent document claims. Retired executive Gerald Lankford, who faced 12 counts including conspiracy and transporting illegal immigrants, was also acquitted of all charges.

"It’s not the fault of the company that there are approximately eight million undocumented workers in the United States," Thomas Green told The Wall Street Journal. "If the government wants to eliminate all undocumented workers it has to take companies such as Tyson Foods out of this business of figuring out who can work."

Tyson’s legal team included Washington partners Griff Green and Frank Volpe, as well as Washington associates Kristin Koehler, Juan Morillo, Jay Jorgensen and Hannah Clayson Smith. The SABW attorneys were assisted at trial by Catherine Hill, Jason Morris, Caitlin Drap and Ann-Marie Marino .

Also to me, but something has to be put into place where ICE does it's job. Employers and private homeowners who hire lawn care, stable cleaning, etc, have been contributing to this problem for far too long.
Like lemmings, these illegal intruders have been breeding us out of our cities.
