Death Penalty For Repeat Sex Offenders Passes Oklahoma Senate

A bill to allow the death penalty to be assessed against a person who commits a second sex offense against a child under 14 years old passes the state Senate.

Any perp covered by this law would have a *very* strong incentive to kill his second victim.

So we add a law for that contingency: death by boiling in oil.

I dont care if it does. If someone rapes and kills your son, I'd rather not pay their living expenses.

What punishment would be acceptable for such an act? Remember this is your child, not someone elses.

Child rapists don't get life in prison. They wind up back on the streets and repeat offend.

Well, that seems like the real problem, and it seems like a better use of the legislature's time. Give them life without parole.

Too bad SCOTUS will strike it down in due time.

How exactly will SCOTUS do that? Death for repeat sex offenders is not cruel and unusual.

C'mon,be serious.Yes,this law would be very satisfying on many levels.I,personally,would like to see more types of crime subject to the death penalty.

But,IIRC,rape (for example) was once a death penalty offense in at least a few states.But those laws were changed for the reason that I mentioned.

Well, that's why I support HR 1035 which would allow public ownership of roof mounted rocket launchers for clearing those kinds of drivers off the road.

A life sentence doesn't seem to stand for much these days. All you need is for some liberal leftist whack-job group to focus on some nut-job, and before you know it Mike Farrel and other bleading hearts will be holding candle-light vigils and recounting the wonderful aspects of the prisoner's personna.

I agree that there are arguements both ways. Thanks for the comments.

Under this law, technically, yes, though the prosecutor has latitude as to what is actually charged. A lewd molestation could turn into "inappropriate touching" for a cooperative, first-time, repentant offender. A rape of a child under 14 is hard to plead down.

So, now that it's a capital crime, what's to stop the predator from killing the kid to keep him or her quiet? I mean, he's in for a penny, in for a pound at that point, so why not off the kid?

There's a similar bill in South Carolina. I saw Bill O'Reilly interview the man who wrote the bill. I was impressed.

I would worry that this law might give the sex offender an incentive to kill his victim.

That was one of the reasons states gave for dropping the death penalty in general - if they get death for raping somebody, torturing somebody, etc., they'll just kill the victim. Well, they kill the victim anyway in many if not most cases, and if anything, realizing that the punishment is no greater for killing the victim is an incentive for killers to go ahead and do just that. Dropping the death penalty has not resulted in a decline in murders, to my knowledge, and is certainly responsible for repeat offenders.

Legislating from emotion is not a conservative trait. If you have to make such an appeal, it betrays a certain weakness of argument.

His question is valid. And maybe the response is "Not at all, but it will make us feel better."

I too am worried about the possibility of abuse. Too many men are accused of molesting their children.

Besides, this whole thing just screams of grandstanding politicians. It won't stand, and the only real result will be a very large legal bill for Oklahoma taxpayers to foot. I wish legislators who voted for such things were actually responsible for the legal costs that result.

Why wait for a second offense. First time offenders get the needle as the victims will live with the pain and anguish for the remainder of their life, while the "sick" offender is treated at state expense.
