This is probably the relevant Florida law (thanks to Sam Spade for the link):

(4)(a) In the event that death, resignation, withdrawal, removal, or any other cause or event should cause a party to have a vacancy in nomination which leaves no candidate for an office from such party, the Department of State shall notify the chair of the appropriate state, district, or county political party executive committee of such party; and, within 5 days, the chair shall call a meeting of his or her executive committee to consider designation of a nominee to fill the vacancy. The name of any person so designated shall be submitted to the Department of State within 7 days after notice to the chair in order that the person designated may have his or her name on the ballot of the ensuing general election. If the name of the new nominee is submitted after the certification of results of the preceding primary election, however, the ballots shall not be changed and the former party nominee's name will appear on the ballot. Any ballots cast for the former party nominee will be counted for the person designated by the political party to replace the former party nominee. If there is no opposition to the party nominee, the person designated by the political party to replace the former party nominee will be elected to office at the general election. For purposes of this paragraph, the term "district political party executive committee" means the members of the state executive committee of a political party from those counties comprising the area involving a district office.

That's about the only thing that'll definitely get you kicked out of politics, until a Kennedy does it.

Not for Democrats (e.g., Barney Franks, Gary Studds). Expectations for Democrats are very low, it seems.

Well,you agree however that if these 'other' sexually explicit emails do come out...that he is a morally bankrupt pervert and should be thrown in jail. Sorry, but it is starting to look true to me. ABC could have one hell of a libel suit on their hands if the reports of the sexual stuff is not true. He resigned after those reports became public and probably for a reason. I hope you are right, but don't hold your breath.

Our main concern needs to be finding someone to replace him ASAP!!

So, it seems that if people "vote for" Foley, they elect the designee. If the district is R enough and the GOP can get out the word, this should not be a problem.

He's doing the right thing by resigning. William Jefferson, Democrat, still keeps his seat after putting $90,000 in bribe money in his freezer.

In Florida, Foley's home state, the age of Consent for minors is 16(heterosexual), 18 for Homosexuals. So yes if this is true, it is a criminal offense.

I wasn't aware of the IM's I agree they are damning and he should have resigned. I guess we should all be suspicious of single men in their 40's!!!

But I am still angry. If this had been going on all along, it should have been brought up immediately by these so called "concerned" individuals. It is less than 40 days before the election, and even sooner if you count "early voting". Instead of bringing this to the light of day when it was happening, they wait until too close to the election to field another candidate but yet far enough out for maximum impact. I could still spit!!!

Fox could be right - as I read it, Foley's name can't be replaced (assuming the primary results have been certified), but a vote for Foley will be considered as a vote for his Republican replacement.

The ones I heard about on the news yesterday were enough to make the boy suspicious and to report his suspicions.

The republicans might survive this election if they don't commit suicide first.

Bush 2004 carried the district by 8%. It looks like Florida law may run to the GOP's rescue. It really couldn't be any better.
