I understand your position. It is an Originalist Interpretation, that the powers of the Federal government are limited and the the Bill of Rights applies only to the Federal Government.
However, the Supreme Court will not take this position. To do so, they would logically have to hold that the First Amendment also does not apply to the states. At least 7 of 9 will disagree.
