More Manson Family victim's bodies found
Fox news | 16 Mar 08 | nully

Breaking on Fox, no link yet.

This means there are new murders to tie to Charles Manson.

Maybe, just maybe, he can get the death penalty for one or more of these.

Assuming the liberal gods in black robes don't block it again to save him.

Unless there was a constitutionally valid death penalty law in effect when the murders took place

Hmmmm. It was overturned by, IIRC, the Ninth District Court of Appeals. His death sentence (and those of many others) was commuted to Life.

The 9th district's decision, like so many of its other bad decisions, was overturned by a higher court. The state was unable (or unwilling?) to reinstate the original penalties.

I'm uncertain how this plays out with newly discovered murders.

No man's Life Liberty or Property are same as long as court is in session.

There was a death penalty at the time; Manson and at least one or two of his followers were sentenced to death- it was a year or so later that the death penalty was repealed and their sentences became life sentences. It would be ironic if Manson were to be tried for another murder now and end up executed. It’s not likely since evidence will be tough after all these years and prosecutor may not be inclined to open a new can of worms with the defendent already locked up for life.

Manson got the death penalty, the Supreme Court of California reduced it to life when the state temporarily eliminated the death penalty. So the murders did occur when the state had the death penalty.

I could be wrong, but as I recall, there was a death penalty in effect when the murders took place and he was sentenced to the death penalty at his trial. That death penalty law, however, was thrown out some years later and Manson got a straight life sentence. The current CA D/P law was passed well after all this, and cannot be applied to him for these old crimes.

Chances are he will die of old age.

I think that happens in roughly half of the cases languishing on death row.

Wonder if either of these “Family” members had anything to do with other murders?

Tex Watson-Since 1993 he has been at the Mule Creek State Prison, and is the father to four children. He remains married and continues to fight for his parole. To date, he has been denied parole 13 times.

Leslie Van Houten-She has applied unsuccessfully for parole on 18 occasions and remains housed in the California Institution for Women in Corona, California along with Krenwinkel and Atkins.

The Constitution explicitly and correctly forbids making something illegal after the fact or increasing the penalties for a crime after it's committed.

Tell that to all the guys who slammed a door in their wife's face years ago, pleaded no contest to minor domestic violence misdemeanors, and then found their right to own a gun cancelled ex post facto a decade or two later.

I wonder if Heller will help rectify this?

N&V, you have to remember—it’s CALIFORNIA. Death penalties are seldom enforced.

Right, he would probably die of old age. And lets not forget what kind of circus his other trial was. I think he would like nothing more than to have the cameras on him again.

nope the murders occured when the country did not have a death penalty.

Huh? Then how did Manson get his original Death Penalty sentence in the first place?

Even if convicted, he [Charlie Manson] will not be put to death until he is over 80 years old.

Then the nasty old fart can savour a last meal of pureed steak, mashed potatoes, strained peas, decafe coffee and prune whip before being wheeled into the death chamber.

No. He went camping. Stupid idiot tried to swim in a mountain stream with a small boulder on his chest.

Manson was unsuccessful in his attempt to use this ‘drowning’ as an excuse for a mistrial...
