It has been a source of ongoing sadness to read of the difficulties Lauren Richardson’s father has had over the course of the past several months. For those of you who are not familiar with her case, Lauren overdosed on heroin on August 28, 2006. She suffered oxygen deprivation and, as a result of the overdose, is now in a coma and unable to speak out for herself. At the time of the overdose, Lauren was expecting a baby. Her parents honored what they knew would have been her wish and did all they could to keep her healthy and comfortable until the child was born. Today, though Lauren may not be aware of it, she is the mother of Ember Grace, who was born in February 2007.

Since the birth of her daughter, Lauren remains unable to speak of her concerns, but she has a loving father who is doing all he can to protect her from suffering the same fate as Terri Schiavo. However, Lauren’s mother, who has been named her legal guardian, is sadly not of the same opinion and is working with attorneys to pressure the courts to permit Lauren’s starvation.

Lauren’s father has kept hope alive, even at times when there appeared to be no hope in human terms. Lauren’s father is a man of hope in Christ and is dedicated to spending every breath he has on defending Lauren, regardless of what it might cost him in physical exhaustion and worldly goods. The most recent update for those concerned about Lauren tells us the following:

We struggle at times as we seek to share with the public the details of what is happening with Lauren because of the disagreement we have with Lauren’s mother. We cannot understand her reasoning in refusing a path of hope, healing and restoration for Lauren and insisting on causing her death by withholding food and water from her. The issue in Lauren’s case is the eternal truth that all people, no matter what their medical condition, bear the image of God and deserve basic care and an opportunity to be restored to health.

Bobby Schindler, Terri Schiavo’s brother, has written about Lauren in an editorial earlier this year, "False Compassion," and is working closely with Lauren’s father in order to provide expertise that he is uniquely qualified to share during a trying time like this.

There are many links on the Life for Lauren web site that will assist you in tracking this case and learning who is supporting Lauren’s ongoing care and who is opposing it. More importantly, there is something you can do to express your concerns.

ACTION NEEDED NOW

The governor of Delaware, Ruth Ann Minner, is being asked by pro-life Americans across this nation to intervene in this case in order to save Lauren from what many fear is an imminent court order dictating that Lauren be starved and dehydrated to death. I am asking you to be one of those who communicates your passionate belief that Lauren’s life is sacred and deserves to be protected from those who would order her death. During a recent visit to Anchorage, Alaska where Bobby Schindler was invited to speak, he told a reporter from The Catholic Anchor, "Once we accept that killing is an acceptable answer to human suffering, we lose any type of parameters. Euthanasia is a form of abandonment. It is not compassion."

Truer words were never spoken. As I frequently tell people who argue that we pro-lifers are being heartless and cruel for fighting to defend the rights of a "hopeless case," "God is the author of every human being’s life, and He has never given permission to a single one of us to arbitrarily rob another human being of life for any reason including disability or illness."

As Flannery O’Connor once wrote on the subject of false compassion, "In the absence of faith, we govern by tenderness. And tenderness leads to the gas chamber."

Lauren Richardson is not terminal – she is severely disabled. Lauren Richardson should not be murdered.

Sam Golubchuk update...

As it develops, Mr. Golubchuk will not be left alone as the disappointed killers stomp out of the building. And those who had counted on the killing team to care for them will get care, as well, and maybe even live longer as a result, my speculation.

The Winnipeg Regional Health Authority has found a doctor willing to be Samuel Golubchuk's physician of record.

The WRHA hopes an agreement reached yesterday with the doctor will put an end to the parade of resignations recently at the Grace Hospital's intensive care unit, where a court order requires doctors to keep Golubchuk, 84, on life support in spite of medical advice.

SCHEDULED ROTATIONS

"There will be one attending physician of record and two others to support that role," a spokeswoman for the WRHA said yesterday. "Others can continue with their scheduled rotations." The spokeswoman said discussions about returning to work were ongoing yesterday between the WRHA and the three physicians who resigned their privileges at the Grace ICU over the past month in the wake of the Golubchuk controversy.

Golubchuk's children were granted a court injunction late last year to keep their Orthodox Jewish father on life support until a hearing could be set to decide his fate. Although doctors have determined Golubchuk has no hope of ever leaving the ICU alive, his children have argued taking him off life support would violate his religious beliefs.

The hearing is set for September.

Health Minister Theresa Oswald said yesterday she is concerned about the situation but will not interfere, as the Manitoba Law Reform Commission decided in 2003 end of life decisions should be left to the courts and to the College of Physicians and Surgeons -- not politicians.

Oswald said she has been assured no patient's care has been compromised as a result of the situation and she understands emotions are running high on both sides.

"I don't think there's anybody involved in this situation right now that doesn't have a broken heart," she said.

Not all are pleased about the departure of the honored killers from the facility. To be fair, this article tries a bit of balance. Perhaps supporters will raise the threat that the facility may be forced to rely on the SIDS group, the Sudden Instant Death Syndrome wiseguy specialists. The danger will be death that smarts just a bit more. Well, here it is...

Samuel Golubchuk is 84 and barely alive, by any definition. He should not be having another birthday before Manitoba's Court of Queen's Bench begins pondering whether he should be taken off life supports. Three doctors have refused to accept shifts at a Winnipeg hospital's critical-care unit because they object to having to treat a man they believe should not be kept minimally alive. If more doctors follow, Grace Hospital may be forced to close the unit. Seven months is too long a wait for a court hearing from the time the court ordered the hospital to keep Mr. Golubchuk alive pending the hearing.

The case involves an unsettled area of law. While the right to be taken off life supports has long been established, the right to demand life supports for vegetative patients does not exist. Mr. Golubchuk's family argues that his Orthodox Jewish beliefs require that his ventilator and tube feeding not be disconnected. But if he is all but brain-dead, an accommodation of their religious beliefs is far-fetched. Accommodation does not create a right; it allows for the exercise of an existing right.......

Whether by trial and error, things will move up, according to this account because the first killer stomped out in tantrum.

WINNIPEG — The trial in the case of an elderly Orthodox Jewish man whom doctors have wanted to remove from life support since last fall is being moved forward at the request of the hospital where he is being treated.

Chief Justice Marc Monnin of the Court of Queen’s Bench has granted a motion by Grace Hospital to move the trial in the case of Sam Golubchuk, 84, ahead to Sept. 15 from Nov. 24 – which would have been almost one year after his family initially obtained an injunction against removing Golubchuk from life support.

The hospital had asked the court for an earlier trial because one of its intensive care specialists, Dr. Anand Kumar, quit rather than continue to treat Golubchuk......

Terri Schiavo's world became one of isolation at the hands of her husband. He made the decisions of who could visit her, if any at all could at any given time. He made the decisions of what therapy she might receive, though he came to reject any therapy at all. He made the decisions about any stimulation that touched her day, including whether the curtains would be open or closed or even a sound of music or voice to touch her moment.

The husband of Terri Schiavo did not see her as a human being, especially after he found Jody and fathered children with her, it would seem. Yes, it would seem that after Jody and the money entered the picture that Terri Schiavo suddenly became a "vegetable", rather than the "wife" that Michael Schiavo was going to faithfully take care of for the rest of her life. (No hint given that he was going to shorten that life from a natural span of time to an ordained and court ordered forced ending of her life when he was seeking the settlement. Of course, that would have limited, or excluded, the initial court awarded judgment, would it not?)

With thoughts of Terri in mind, I do wonder about Karen Weber.

I know that Raymond Weber is supposed to have said that he didn't want his case to turn into a Schiavo one. And that means?

Does that mean that Karen Weber is being afforded every opportunity of recovery no matter how big or small the effort?

Is she receiving time?

Is she receiving therapy?

Is she receiving comfort and encouragement from family and friends?

Is she receiving stimulation to jump start those recovery cells?

Or ... is she laying there often alone, unless or until her husband, the court, or some appointed person decides that she has a right to the comfort of family and friends and the encouragement of hope and effort by medical and therapy staff (as well) to make her better?

It will be the actions that tells us, one and all, whether Karen Weber is being given a fair chance at recovery, or still another Terri Schiavo in the making. Indeed it shall be! Indeed, the world shall be watching both today and tomorrow!

Today's Winnipeg Free Press reports that two more doctors have resigned from their critical care rotations at Grace Hospital. There is a lot going on here. I just want to flag four interesting issues:

  1. The doctors had acceded to family demands because Samuel Golubchuk's level of care had remain unchanged. But, more recently, Golubchuk's level of health has been declining. Dr Dave Easton explained: now, there is an "insurmountable problem with wound infections and resultant sepsis and renal failure. The patient now had required an escalation in medical support to sustain life, which . . . would only increase suffering and provide no benefit."
  2. Dr. Easton asked "Do protential legal consequences and threat of 'jail' take precedence over my duty to not inflict further harm to the patient?" While Easton's answer is "no," most U.S. doctors would (and do) answer "yes." Moreover, most doctors in most similar situations would only face some potential exposure to tort liability. Dr. Easton is violating a court order.
  3. The duration of the preliminary injunction in this case has already been more than six months. The resignations show that is too long. Indeed, in most cases, the preliminary relief is dispositive, since the patient dies before a full hearing on the merits. In effect, injunctions ordering continued life-support pending trial are de facto final rulings in favor of surrogates and against providers.
  4. If the Grace ICU really must close, that presents a new argument in favor of empowering providers to refuse inappropriate treatment. Others in the Grace catchment area may be adversely affected because Golubchuk, in effect, scared away all the critical care physicians.

I cannot help but think it was our own Wampus SC, who later got the zot because of another also zotted, who flipped on the light switch for the Texas Futile Care Law. When Wampus brought the plight of Andrea Clark to our attention, the law wound up naked in public to the shock of the world. For we soon learned this law had other uses. It was designed to limit futile medicine and care to patients who would die anyway and where it obviously was of no help. With a shift of vocabulary in the leftist lexicon, "futile" came to mean the value of life of the patient-victim, and not the useless medicine. It had opened a playground in the dark for the death cavorters.

Wampus switched on the light.

The Republican Party of Texas held its convention this past weekend in Houston. One tenet of the adopted platform, as reported by The Lone Star Report, is

“Treatment pending transfer” for those facing the end of life – a mandate that requires hospitals and physicians to continue life-sustaining treatment upon request unless another facility can be found for the patient. Current law allows physicians to withdraw treatment they believe is medically inappropriate after notice and review by a hospital’s ethics or medical committee.
As the Republican party is the dominant party in Texas, this could spell the end for Tex. Health & Safety Code section 166.046, the dispute resolution mechanism in the Texas Advance Directives Act. This mechanism barely survived a host of state House and Senate bills during the winter of 2007, many of which contained material amendments. Those same bills and others are sure to be introduced in the 81st Regular Session that begins January 9th, 2009.

As another has pointed out, as this enemy, the Texas Futile Care Law, falters, decent people may relax a bit, but what is needed is to push all the harder, give no quarter, offer no mercy until this evil is erased. That goes for all. Evil enemies in their defeat cry out for cease fire, for unfair and for other mercies understood of people of good will, but that ruse comes from Satan himself, and they will gleefully turn any mercies offered back upon their conquerors.

It applies here and in all our battles against the death enthusiasts.

That is because most fights are negotiations where display of mercy is important in a final good outcome. Not here. We are not fighting for a dilution but for total collapse of the enemy. Its war not a fist fight. So where the saints are winning, pile on, pile on.

A doctor from Winnipeg's regional critical-care program has agreed to be "physician of record" responsible for the care of an elderly man on life support at Grace Hospital, a spokeswoman for the Winnipeg Regional Health Authority said this morning.

"That physician will be supported by two other physicians," said Heidi Graham. The three doctors from the regional critical-care program do not normally have shifts at the Grace, Graham said.

Graham did not release the names of the additional doctors brought onto the intensive care rotation.

The hospital is under a court order to treat 84-year-old Samuel Golubchuk, who has been on life-support since last November and is relying on a feeding tube and a ventilator.

Hospital officials decided last year to end Golubchuk's life support, saying he had virtually no chance of improving. But the Golubchuk family took the matter to court, saying the move would violate his beliefs as an Orthodox Jew. Removing the ventilator or feeding tube would constitute an action to hasten his death, they argued.

Three critical-care doctors at the hospital have declined their shifts in the ICU, effectively cutting the hospital's critical-care complement of doctors in half, before additional doctors were brought in.

Doctors Anand Kumar, Bojan Paunovic, and David Easton quit their shifts recently.

In a letter to the Free Press, Easton said he wanted to share some of the "emotional and ethical turmoil" he went through in concluding that treating Samuel Golubchuk would violate his oath as a doctor to do no harm.

Easton said he felt pressure from the courts, which ordered the hospital to continue treatment of Golubchuk, and the man's family, who said withholding treatment that would end his life violated his Orthodox Jewish beliefs.

Discussions were happening yesterday to bring back the physicians who have declined shifts, Graham said.

WINNIPEG, June 18, 2008 (LifeSiteNews.com) - In a new development in the case of Samuel Golubchuk, three doctors in Winnipeg have agreed to treat the 84-year-old man after several of their colleagues refused to do so.

Yesterday LifeSiteNews.com reported that two doctors - ICU director Bojan Paunovic and specialist David Easton - had refused shifts at Winnipeg's Grace Hospital's rather than treat Golubchuk, claiming that it was unethical to continue providing food and hydration to the severely disabled man. This is in addition to the resignation of Dr. Anand Kumar, the doctor who originally wanted to remove Golubchuk from food and hydration last fall.

Dr. Kumar said he withdrew his services because it is "in violation of my medical ethics to continue (treating Golubchuk)." He also said he believes that the "services administered in accordance with the court order are not of any medical benefit," and in fact cause harm to Golubchuk because they are uncomfortable and painful.

Golubchuk's family, however, is continuing to fight for the 84-year-old man's life, arguing that, contrary to media reports, he is not in a vegetative state and that he is only receiving the most basic care of artificial nutrition and hydration. His family says that euthanasia is against Golubchuk's Orthodox Jewish beliefs.

Heidi Graham, spokeswoman for the Winnipeg Regional Health Authority, announced this morning that three doctors from the regional critical-care program, who do not normally have shifts at Grace Hospital, have come forward and agreed to provide care for Golubchuk.

"Our regional critical care program and hospital have developed a plan that involves having one attending physician of record for the patient in question," Graham told CBC News.

"This physician will be supported by two other physicians. These three physicians have already agreed to this, and this situation will allow the other physicians in the Grace intensive care unit to continue with their scheduled rotations if they so desire."

The names of the additional doctors brought onto the intensive care rotation have not been released.

A bioethicist offers his perspective...

Vancouver -- As a medical ethicist who works with medical students, and in medical situations, I teach that the idea of patient choice is paramount. The case of Samuel Golubchuk (Two More Doctors Resign Over Life-Support Order - June 18) makes a mockery of that principle. If the doctors' actions go unchallenged, it will amount to saying that patients and their families are free to choose - as long as they choose what a physician approves. That, alas, is no choice at all.

Certainly, there are bounds to patient choice, but those bounds are typically limited to actions causing real and long-term harm. This case, in which the dying patient's family seeks his continuance, does not appear to rise to that standard.

SYLVANIA -- The sister of a Toledo native, caught in the center of a life and death controversy, is speaking out.  It’s an interview you’ll only see on NBC-24.

 

Joyce Tatro-Manes of Sylvania refuses to let go of the bond she has with her big sister Karen Weber.  A bond tested to the limits after a debilitating stroke left the Toledo native in a Florida nursing home dependent on a feeding tube.

 

“As far as I’m concerned, everyday that we have with her now is borrowed time.” Joyce Tatro-Manes.

 

Seven months after the stroke, Joyce and her family find themselves battling Karen’s husband, Raymond Weber and the couples children.  They want to see the 57-year old removed from the one thing keeping her alive.  Joyce maintains her sister is responsive, and knows what’s going on around her. 

 

“Just because someone is impaired, or disabled, doesn’t mean their incompetent and that they don’t know what’s going on and that their not worth something.” Tatro-Manes.

 

The facts of this case closely resemble that of the Terri Schiavo saga.  Joyce has actually been in contact with Terri’s family.  She remembers her sister’s reaction to the story back in 2005.

 

“They actually sat around the table when all the things were happing with Terri Schiavo.  Ray said ‘I’d want to let her go too.’ and Karen said ‘Well, I think he just wants to marry that woman. I think that’s terrible.’  She made her thoughts clear that she sided with Terri Schiavo.” Tatro-Manes.

 

And now, three years later, much like Schiavo, the fate of Karen Weber is in the hands of a Florida judge.  Three doctors are reviewing Karen’s case.  They will tell the judge if she’s competent, or if guardianship should be handled over. 

 

NBC 24 tried calling Raymond Weber at his Florida home, but there was no answer.

A former Toledo woman is at the center of an ethical debate about life and death.

Karen Weber is reliant on a feeding tube in a hospital in Florida. Her husband wants to remove the tube, but her family wants to keep it intact.

Karen's ordeal began in November of 2007. She suffered a set of seizures that led to a debilitating stroke and now she lives in a nursing home, hooked up to a feeding tube. She is paralyzed on her left side and can't speak, but she breathes on her own.

The battle lines have been drawn between Karen's husband and the rest of her family, including her parents and sister. Her husband believes his wife is in a vegetative state. He wants Karen transferred to a Hospice facility where she'll likely die. Her parents and her sister Joyce, who still lives in Sylvania, believe that she is alert and responsive. They say she blinks answers to questions and even laughs at jokes.

Now, a Florida judge has issued an injunction forcing three doctors to give their opinions about whether Karen is capable of deciding to live or die.

This case is reminiscent of the 2005 case involving Terri Schiavo, where ultimately her husband won and her feeding tube was removed. She died two weeks later.
