Appeals court sides with Ohio secretary of state

CINCINNATI—A federal appeals court sided with Ohio's top elections official Friday in her running battle with Republicans over how to verify the eligibility of newly registered voters.

The 6th U.S. Circuit Court of Appeals set aside a federal judge's order a day earlier that Democratic Secretary of State Jennifer Brunner institute the means to verify voter registration information and make it available to Ohio's 88 county election boards.

Brunner argued that it would take two to three days to create the necessary computer programs, and that nothing in the Help America Vote Act required her to do what the lower court ordered. A three-judge panel of the appeals court agreed in a split decision.

"With less than a month until the election, and less than two weeks until the beginning of counting absentee ballots, the secretary cannot be required to undertake the extensive reprogramming and other changes to the election mechanics without complete disruption of the electoral process in Ohio," the majority said in its opinion. "The irreparable harm to the voting public caused by the district court's order is equally clear."

On Thursday, U.S. District Court Judge George C. Smith in Columbus ordered Brunner to verify new registrations by matching information on them against a database maintained by the Ohio Bureau of Motor Vehicles or the Social Security Administration. He also ordered her to establish a process by which the county boards can access the information generated by the checks.

Brunner praised Friday's decision, saying there are sufficient systems in place to verify new-voter registration.

Judge B was very smart, but even back then, back in the mid-90s, he was an interesting cat. You had to bend over backwards 175% to please him. He’d rip anything and everything you did wrong, even if it was 90+% correct, and as long as at the end of the lecture about the 10% wrong, you said, “ok” or “I’ll fix it right away,” then he would would turn into sugar sweet. You’d get 15-20 minutes of railing you over the coals, then 3-5 minutes at the end of sugar sweet. But, he was in his midish 70s (think McCain age, but a little older), and he wasn’t 100% there on remembering things....we had to remind him of things often, even back then. Kinda like the long-term memory was sharp as a tack, but recent things were fuzzier...this was seriously 12+ years ago...I can’t imagine that he wrote this - he’s 90 for gosh sakes!! He just signed on as the killer in the appeal to make it go to the Sec of State way...

I called the election commission in my previous residence county, Medina, Ohio. I wanted to make sure that my name was removed from the list of voters. She said that it had, and I was relieved. I told her exactly why I was doing so - I had moved out of state and had seen on the news that there was some group called ACORN that was generating fraudulent votes, and that I didn’t want someone to use my name to vote. She didn’t seem too interested.

that said, McCain is determined to win this ‘his way’, which is a myopic prescription for disaster.

McCain foolishly, stupidly threw away the Hussein middle name yesterday too. It’s BO’s name, for God’s sake. Use it. REPEATEDLY. Did the RATS ever refrain from using J. Danforth Quayle? Richard Millhouse Nixon?

We have nominated the wrong guy. With his knowledge of global markets and his telegenic skills, Romney would be kicking the RATS to the curb over this economic meltdown and we’d probably take back the House too. Like Reagan in 76 and 80, Romney could run AGAINST Washington - we have no such luxury with McCain.

Thank you again, Mike Huckabee, for this looming disaster.

Well the Appeals Copurt has assured one thing in Ohio.

Huge battles when votes are counted, and possible rioting.

These petty-fascists are about to learn the true meaning of disorder on election day, as film cres record people who vote multiple times.

So much for social order. And thuggishness will be met with patriot force of the day.

One wonders why Appeals judges are not concerned with social order? The court of first instance certainly was.

The fix was in since the democrat primaries.

You've got that right. If this moron somehow wins, it will be due to massive fraud. Americans don't want socialism - that is evident by the huge negative reaction to the bailout. And they certainly don't want a socialist/communist tool in the White House. The only way Obama can win will be through massive fraud. He's got his judges and other officials pulling the levers of fraud for him, manufacturing votes in every major city in this country.

This election is a farce - an Obama Presidency will not be a legitimate Presidency. We'd better stand up and deal with this NOW!

One wonders why Appeals judges are not concerned with social order?

Because they don't think that the Right will fight? Because they mistakenly believe that only the Republicans are against voter fraud?

Frankly, this country needs a little social disorder in order to restore it to its constitutional roots. I'm talking something a little more serious than chanting in front of the Vice President's house. I mean, it's time for conservatives to fight back for a change.

The US Supreme Court is definitely involved in this federal election. So, onto the Court, I say!

If you think the society is "idly standing by", you are sadly mistaken, and not uptodate with the news. ACORN is being investigated or sued in Courts across the land. Ohioans are burning up the phone lines and emails into Brunner's office, and petitions for her impeachment are already circulating.

No one is standing by; they are actively pursuing these injustices.

I just spoke with Sarah Palin yesterday; she flew into Cleveland for a fundraiser. She said this is going to be a hard-fought election, and we are not to give up!

So, go be an observer. I am volunteering at a McCain center in Cuyahoga county. Hold that line.

The judge that rendered the decision that this appeal is trying to overturn was a Judge Smith, and he was a Reagan appointee.

Ask someone not glued to FR or cable news and you will get blank stares. There is a good 45%+ still thinking Obama is qualified. They think his connections to Ayers isnt that big of a deal and that he had nothing to do with the finanical collapse.

Dont be so quick to assume you are the common conception. We are addicts and uniquely tied to all the going ons with the campaigns but there is a very large block of people who either hate politics and dont want to hear it (but think Obama is a "good change") and then there is the other block that just wants socialism/marxism and knowlingly want the fraud to go on.

Go to the McCain centers, and see what is happening there. People are coming from out of the woodwork, and they KNOW all about obama and ACORN. They are not freepers or news junkies, either.

I've noticed, from reading the news on the internet for a decade, that there are people who always speak ill of the American people, and underestimate them.

There are sheeple, but they do not amount to 45+%.

And do not forget: Clinton was elected and re-elected because of Ross Perot. If Perot had not been in those races, Clinton would never have been president.

AND the America people elected W and re-elected him.

45%+ goes to the recent polling Obama's getting. Thats a mix of sheeple and straight up marxists/socialists. It's great the base is motivated and going out for the ticket but the mushy middle typically doesnt go to these rallies or centers. I have 3 direct friends who want no part of the ACORN,Ayers, Wright info and just put their fingers in their ears and go "BLAH BLAH BLAH" and these people are good, decent people who hold pro-life, pro 2nd amendment views.

They are sick of the politics.

There is so many more of those people than I think you realize. You think im happy about that? I see it daily and its infuriating.

LOL They have no choice. The issue is both too big now, AND they are gonna hear it from US if they don't. What we did to the Congress with that bailout we can do again to the USSC. Just think Florida Recount. If the USSC makes a decision its the law of the LAND and ALL 50 States MUST follow. BIIIIG big deal. They will HAVE to hear it and make a very timely decision. And it should be easy, we will see how good and which side our supremes stand on. If they side with NOT protecting the Purity of the Vote, then I really will fear for this republic, because it will mean our vote is irrelevant. The United States will have shifted to a Socialist State. They will have to take the case.
