Could Nancy Pelosi be our next President?

The news seems to indicate that there is a problem with Obama’s birth certificate and some states are talking about holding their electoral votes. If this becomes the case I see several possibilities and am asking for your feedback.

1. The States where Obama won withhold their electoral college votes and McCain wins by default.
2. Because of the ciaos of Obama not being a citizen there is a delay in deciding what to do, on January 20 2009 Nancy Pelosi Speaker of the house and third in line become the President.
3. I don’t think Bidden would step up because has yet not been sworn in and not officially the VP yet. Besides the vote was for Obama for President and not Bidden it would either default to McCain or to Pelosi.
4. If Pelosi were a planer she could arrange to have a crises that took the USA past the swearing in time and by default become the first American Woman President, heaven forbid.

That is my take if Obama fails to prove citizenship.
What do you think?

good gawd man, that is just a cruel thought! the worst ticket i could imagine obama prez, pelosi vp. i could not build a hole big enough to move into. now i will have night terrors!

The electoral college process was set up to separate the executive function from the legislative function. The electoral college also serves as the last sanity check before the winner of the election is made President of the US. If BO citzen status disqualifies him, the electoral college delegates at the instruction of the states they represent can elect anyone or no one. McCain will not be picked because the Dems won the election, thus Biden is the most logical choice but Clinton can lobby the states to instruct their delegates otherwise. In the mean time the swearing in is delayed and President Bush will remain in office till it is resolved. The tricky part is if BO is sworn in and his citizen status is revealed later. At that point only Congress can remove him by impeachment. If the Dem control Congress refuses, the US Constitution and our Republic will cease to exist.

Egads!

I consider that thought to be life insurance policy for the Obama/Biden ticket. There *is* someone worse than obama who could be President.

No matter how much I may dislike the thought of Obama as President, I will now pray more fervently for his and Biden’s health and continued service for the next 4 years!

Nancy Pelosi’s term as speaker of the house ends when congress meets to elect a new speaker in January. She can only inherit the presidency before that vote if George Bush and Dick Cheney both are incapacitated and unable to serve out their terms. Her term would end when the next president takes the oath of office in January.

The Electoral College, however, could be interesting, if one of the members stands up and demands to see Obama’s birth certificate, and raises questions of citizenship based upon reports of traveling under an Indonesian passport. I believe this is actually the only way the SCOTUS would step into the question, if such a request is made, and refused by the body.

It is an interesting legal question if Obama must submit to any requests by the body to produce any documents; I'm sure the SCOTUS would rule that they have no powers to compel Obama to produce anything, but are welcome to take that refusal into account in their voting. And probably would be willing to require the College to meet a second time, and re-vote, should a vote take place with the question unresolved on the floor about any existing questions on documents. But they'd also point out that the only body that can compel Obama to produce them would be congress, as part of an inquiry for impeachment.

If Obama is found to be unqualified to sit in the office, at that time, the Electoral College can choose anyone they wish to be president, with the exception of Biden. As his name will be on the VP ballot, he can not be elected president by the body. Pelosi’s name could come up at that point and be voted upon, but I would bet that it'd be Hillary's name and election that would actually happen, with Biden proposing it himself. The majority of electors will be Obama faithful, who would stand in opposition to Pelosi and co.

But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in the case of the death or other constitutional disability of the President.

If BO is found to be Constitutionally ineligible AFTER the States have certified their results, then when the votes are counted in the Senate, both for President and Vice-President, BO’s will be ignored, and only Joe Biden will have a majority, and will be elected. The interesting thing here is that under the Constitution, Article 2, Section 1, in such a circumstance, John Mccain would become Vice-President.

Check out Article 2, Section 1. It’s a bit confusing, but clear enough.

If BO were to be found ineligible BEFORE the States certify their votes, then I agree, the States would generally be free (within the constraints of each State’s own laws) to instruct it electors how to vote.

There is NO circumstance here which could result in a delay to the swearing in of a new President.
