Supremes to review citizenship arguments-Case challenging candidacy set for 'conference' of justices

A case that challenges President-elect Barack Obama's name on the 2008 election ballot citing questions over his citizenship has been scheduled for a "conference" at the U.S. Supreme Court.

Conferences are private meetings of the justices at which they review cases and decide which ones to accept for formal review.

This case is set for a conference Dec. 5, just 10 days before the Electoral College is scheduled to meet to make formal the election of Obama as the nation's next president.

The Supreme Court's website listed the date for the case brought by Leo C. Donofrio against Nina Wells, the secretary of state in New Jersey, over not only Obama's name on the 2008 election ballot but those of two others, Sen. John McCain and Roger Calero.

Yes it is.. every state has a short form and a long form... ... the long form is where the parents sign etc. Moreover, you made my point overall when it comes to the birth certificate.

Ok, help me out here.

Our youngest daughter was born in Canada. We lived on the border, and chose a Catholic hospital about an hour from our home, because they were the only one in our area that would allow father in the delivery room. (This was back in 1971)

So, she had dual citizenship, and didn’t declare for the US until she needed to, sometime around her 21st birthday. Is she eligible to be President?

She is one smart, organized and talented cookie, and very conservative, so I know she would be a good one!

No, she is not eligible to be POTUS although she is a citizen, she is not considered natural born! Sorry!

Per Donofrio, “anchor babies” are citizens but not natural born citizens since their parents are alien to the USA.

Could you imagine what would happen if this was actually taken up as a case and if they HAD to rule against obama. The moonbats would go ballistic ... and the Supremes don't want that to happen.

Why is it that everyone who posts this theory never imagines that the reverse might happen if the SC decides in favor of Obama?

Don't doubt for a moment that the Supremes are between a rock and hard place with this. Even if they somehow weasel out of making any decision at all, it will be viewed by millions of Americans as an abject dereliction of duty on their part.

And if the SC is too cowardly to enforce the rule of law and our very Constitution, then what right does the federal government have to enforce the same upon us, the law-abiding, taxpaying citizens of America?

Trust me, there is going to be an uproar no matter which way this goes.

“Of course, if it says he was born in Kenya, 0 will know that before he turns it over, so he will NOT turn it over. The question is will he turn over a forgery or ignore them instead?

Showing another forgery allows the supremes to save face and not force a showdown, if it’s at all convincing to a lay persons eye. This is the route I’d bet on, if of course his real BC says Kenya.”

Surely the Court could take steps of their own to secure his birth certificate, without have to rely on him handing it over. It is part of the official record, after all.

Our side doesn't "revolt", the other side does.

I refuse to let such a bald faced insult to the dignity of our forefathers go unanswered.

"Our side" is the side that revolted against King George of England in 1776. The libs? Their kind were around then, too. They were all Loyalists to the British Crown, or were cowardly weasels, to worthless to choose sides. This is historic. Look it up sometime.

"Their side" only riots. They don't have the stomach or courage for real revolution, as our forefathers did. And, as do we.

“Cab you imagine setting the stage for future conservative presidents or senators having to have their BS vetted by a liberal supreme court?”

How difficult would it be to produce a birth certificate showing you were born in America? Because that’s all that would be required. Obviously, Obama is in no position to do that.

“If it is heard, expect a 9-0 decision against Obama if he cannot establish that he is a natural born citizen. The constitution is very clear.”

Didn’t you get the memo on Nov. 4th? The Constitution no longer matters any more!

The libs can and will do what ever the hell they want!

Thank you, Frank. That was well said, and it communicates with clarity, what is actually at the heart of this matter.

I’m fairly certain that Scalia, Thomas, Roberts, Alito would not be silent.

I am not so sure. They are all very smart individuals. I'm sure they would note how little interest in pursuing this exists among the media, how historic it is that a Black man was elected and how damaging it would be to invalidate the election (probably riots and threats to their lives).

“Finally, consider the implications of a man who would undertake these devious machinations to knowingly assume an office that he has no constitutional claim to, and than to see this same counterfeit president elect take an oath to defend that constitution. I believe that such a man would be willing to impose ANY sort or despotism or tyranny upon us to retain power.”

Yes.

“...the end result would only be the complete destruction of the United States Constitution in order for the Libs to have their way. Can you even imagine what that would be like?”

I thought we are currently living with that everyday?!?!?
Social Security ...
1934 NFA Act ...
1968 Gun Control Act ...

Aren’t all of those things that passed through the SCOTUS truly unconstitutional?

Whats one more unconstitutional act going to do? Break the bank?

Face it ... the US is OVER WITH ... PERIOD!

Good point. I forgot that. But he did that trip as a US Senator. I think they travel on a different set of documents, State Dept passport. Not positive, just what I think.
