Trampled Man's Family Sues Wal-Mart

GARDEN CITY, N.Y. (Dec. 3) - The family of a worker trampled to death in a "Black Friday" crush of bargain hunters at a Long Island Wal-Mart store filed a wrongful-death lawsuit on Wednesday, claiming store ads offering deep discounts "created an atmosphere of competition and anxiety" that led to "crowd craze."

The lawsuit claims that besides failing to provide adequate security for a pre-dawn crowd estimated at 2,000, Wal-Mart "engaged in specific marketing and advertising techniques to specifically attract a large crowd and create an environment of frenzy and mayhem and was otherwise careless, reckless and negligent."

In addition to the retailer, the adjacent Green Acres Mall, a realty company that manages the property and a security company hired to patrol the property were all named as defendants.

Police are reviewing store video to identify possible suspects in Damour's death, but Mulvey conceded that criminal charges are unlikely.

Hecht said Damour's family also plans to file lawsuits against Nassau County and its police department.

The lawsuit against Wal-Mart and the other companies was filed Wednesday in state Supreme Court in the Bronx, the home of one of the victim's sisters, Elsie Damour Phillipe, the court-appointed administrator of his estate. It does not seek specific damages.

Ok what should we be calling these people? All across America stores had these exact same sales. This didn’t happen anywhere else. Why? Because of the people involved. In one of the first stories I read about this they said the savages were mad that Wal-Mart was going to close due to this death. Frankly I am getting tired of people defending these people.

Oh bull, I was about the only one defending the crowds, myself and one other. The rest of you were like the crowds you accused, viciously going for their jugular. Was it because it was a black crowd that you call them animals?

Get stuck in a crowd once and see what it’s like. I’ve had the experience, and it’s no fun. You get panicky, because you are being moved along by osmosis, no control over it. I feel sorry for the guy, and I think anyone who participated in breaking in the doors should be in trouble. Otherwise, frankly, it was bad karma, and the store is not at fault, the crowd was doing what crowds do, wait for the doors to open and then press forward. The problem is there was too large a crowd trying to squeeze in through the doors. If I were that particular store, having had this particular experience, I wouldn’t do anymore early bird specials.

And yes, it could have happened at some other unlucky store too with such a large crowd. What you are doing is condemning ever single person within that crowd as all being equally culpable and all being savage animals. Does not compute to any rational thinking person. My calculated guess is that there were plenty of people stuck in that press of a crowd who wish they weren’t being pushed along. But they were, and they couldn’t have stopped it, unless they too wanted to get trampled. If you want other examples of crowd momentum, just look to all the people who get trampled to death or asphixiated when making their pilgrimages to Mecca. Happens almost yearly. Just last year it happened when Shi’a pilgrims in Iraq got trampled when crossing over a bridge because they thought they were being attacked. It happens a lot. How many soccer fans have been trampled going into stadiums overseas? For whatever reason, you want to really go after this particular crowd, and I think it having happened in a black community store has something to do with it.

It appears you just want to have an issue to be indignant about and to feel superior to those “animals” caught up in the crowd. Group hate based on no logic is not a pretty sight. But you have your nice day. It would be a better day for you if you cleared the animosity towards a lot of innocent people caught up in a bad situation out of your mind, and then have a nice day.

Ah, my instincts about you were dead on. Just visited your FR home page. Funny how it’s chock full of the Durham rape case against the Duke LaCrosse team, and another case where blacks were involved. So you think they are all of the same type of behavior, bad behavior. Now it all makes sense. Boy, I smelled it a mile away. You are not enamored of the behavior of most blacks, are you. Because the people that did this have little to no money. I guess if people were convicted for this it would hurt the civil case chances against Wal-Mart.

Your point was clear to me, and I certainly agree with you. The other person also threw out an example of hajjis’ being trampled on the way to mecca. That really tugs at my heartstrings.
The earth could open up and swallow mecca, along with all the pilgrims, and the world would be a better place.

I said "animals" first (at least on this thread). I never made any reference to race. The "animal" analogy comes about because of exactly the type of behavior you've described repeatedly: the mob-like out-of-control surge of bodies. Think STAMPEDE.

If you owned a Temp Agency would you sue your biggest client (and the largest employer in the world) over a single $200,000 death benefit claim and then never ever be used by them again? Or would you just chalk it up as a business expense?
