Chardon - A transgender woman who exercised her elderly husband to death in a swimming pool was sentenced Friday to four years in prison.
Christine Newton-John worked 73-year-old James Mason's weakened heart until it gave out and stopped beating, prosecutors said. Geauga County Common Pleas Judge Forrest W. Burt told Newton-John that she showed "an indifference" to her frail husband's physical condition.
The 41-year-old pleaded guilty in February to reckless homicide, a third-degree felony with a maximum penalty of five years incarceration.
Newton-John apologized in a shaky voice for pushing Mason too hard on that June 2 day. A surveillance video at the Middlefield apartment complex where the couple lived caught the last minutes of Mason's life, a span where he was literally dragged around the pool by his arms and legs.
She said she loved Mason very much, and that he accepted her "for who I was, not what I was."
Newton-John was born a male under the name John Vallandingham, but underwent gender reassignment surgery in 1993. She chose her new last name to honor her favorite pop singer, Olivia Newton-John.
The couple married in 2006 in Kentucky, a state that allows people to change the gender on their birth certificate to permit the union.
Mason, a longtime family friend, knew his wife from her birth as a boy.
Geauga Public Defender Robert Umholtz criticized the media for sensationalizing the case given his client's background and that the coverage played a role in her pleading guilty. He said Newton-John, a former health-care worker, never intended for her husband to die.
The surveillance tape showed Mason willingly getting in and out of the pool several times, Umholtz said. He said reports of Newton-John working Mason against his will were "misleading."
Middlefield Police Chief Joseph Stehlik previously called the tape "bone-chilling" and the case "very sinister." Police had investigated previous claims of Mason being abused, the chief said. Investigators suspected Newton-John forced Mason's death to claim his assets.
