Reminds me of what I experienced years ago in San Diego’s Balboa Park. At the time I was an avid amateur photographer (before digital). I was across the Prado (then a street, now a promendade) and was framing views of the lily-pad -festooned reflecting pool in front of the lathe-constructed botanical building (San Diegans will know it). Suddenly a middle-aged woman across the Prado shouted at me to stop taking photos of her. I had not yet taken a picture and had no intention of taking one of her; in fact, I had taken no notice of her until she shouted. I assured her I was not taking a photo of her. She persisted in strident shouting that I stop and that she would call the police if I didn’t. I replied that she should call the police for I had done nothing wrong. In a few minutes a patrolman arrived. I explained the situation, adding my opinion that the woman was crazy; i. e. paranoid, while she woman shrilly continued to insist that I had been taking photos of her. I had taken none. The policeman first asked for my camera so he could remove the film. I refused because I had taken other photos that would be ruined. He then asked me to move on which I said I would but only because that already was my intention. I’ll never forget this goofy experience.

He should just book a flight to Miami and go to Haulover Beach and take all the pictures or videos he wants. They don’t care.On saturday and sunday’s it’s packed out with thousands. By the way it’s a legal nude beach. I’ve never been there but I read about it on their website. Sounds like a good place to get that “all over tan”.lol

I agree it's offensive, but I don't think a lot of people realize that some of these laws against photography exist. Prior to this article, I didn't. But apparently Florida, Texas and Alabama have them and probably many others. From what I can tell Florida's law is a "voyuerism" law. According to this site

"To prove the crime of Voyeurism, the State must prove the following three elements beyond a reasonable doubt:
1. (Defendant) secretly [observed] (victim).
2. The (act alleged) was done with a [lewd] [lascivious] [indecent] intent.
3. When (victim) was observed [he] [she] was in a [dwelling] [structure] [conveyance] in which [he] [she] had a reasonable expectation of privacy.

It sounds to me like the only question is whether SeaWorld is a "structure".

There was an athletic trainer in Texas charged with a similar offence for having 1000 pictures of "fully clothed" children. Without seeing the pictures taken, I wonder how they determined the pictures were taken "with the intent of sexual gratification".

How do you know how the women he was taking pics of were dressed? And, it really doesn’t matter - he was in the wrong not them. I guess if he raped one of them you would think it was their fault because of the way they dressed.

Taking pictures of women is equivalent to rape? There was a time in the 1970's (and they are still with us) where some women felt that a mere stare was a sexual assault. where do you stand on men staring at women?

Well that's the question. Apparently you have to be in a "dwelling, structure, or Conveyance". I'm not sure that you could have a reasonable expectation of privacy at SeaWorld per se. But if you are bending over to feed the dolphins, I can see where there is a reasonable expectation that nobody is hiding in the bushes, taking pictures of your butt.

According to attorneys who represent photographers, the answer to your question is "No".

However, SeaWorld is private property, so I would guess that it's more like a shopping mall than a public sidewalk.

The key phrase there is “reasonable expectation of privacy.” There was none. The state can’t win this. Unless they pack a jury with a dozen repressed, man-hating lesbians. And get Hillary Clinton as the judge.
