Adesperate — and ridiculous — claim that Sonia Sotomayor would not be the first Hispanic justice to take the U.S. Supreme Court bench is very revealing. There are actually people claiming with a straight face that Benjamin Cardozo, appointed to the court by Herbert Hoover in 1932, was the first Hispanic justice.

Personally, I could give a damn what *race*, *creed* or *orientation* to which Sotomayor or Cardozo belong. But, using this as a partisan slap in the face is only something a true, diehard leftist would attempt.

BTW: Google *Cardozo* as notice it is Spanish in origin.

So considering Cardozo to be Hispanic really reveals the amorphous — thus slippery — definition of the term. I've never really liked it. Don't like writing it, and I don't much like being labeled that way.

But dammit, I am going to write an entire column arguing about it.

but he is the wrong hispanic for the racists.

isn’t this why they adopted the “Latino” designation? People miss the fact that “latino” was often used as derrogatory for illegal alien in the USA.

Hispanic just meant descended from native spanish speakers.

So why else would racists who support Sotomayer hate Cardozo?

With all due respect to the late judge, he wouldn't make the cut if you define "Hispanic" as people descended from the countries that were once ruled by Spain in the New World.

Why not use the federal government's definition, junior? "The [federal] OMB defines Hispanic or Latino as 'a person of Cuban, Mexican, Puerto Rican, South or Central American, or other Spanish culture or origin regardless of race,' " and that determination is "based on self-identification." It is NOT limited to "people descended from the countries that were once ruled by Spain in the New World."

Typical media bull crap...

We could call you 'Arnold', which is about the most Hispanic name I can think of.

If Benjamin Cardozo doesn't get to be regarded as Hispanic, then neither does Martin Sheen (Emelio Estevez) or Desi Arnaz or newspaper editors named Arnold Garcia Jr.

Cardozo's family was descendant from Sephardic Jews from Portugal. Since that is part of the Iberian peninsula, he was of Hispanic descent.

I doubt Ben ever gave it much thought though nor, I'll bet, did he ever let it influence his judgment.

I guess he just wasn't Hispanic enough for today's identity whores.

No. He's a far-left-wing socialist. He's perfect. Clarence Thomas is the wrong black for blacks. So are Thomas Sowell, Larry Elder and anyone else who believes in The Constitution and the primacy of the individual over the group.
