Soldier suing after being stripped of Subway restaurant franchises

While serving in Afghanistan with the U.S. Army Reserve, Leon Batie Jr. dodged roadside bombs and scrambled to safety when rockets pierced the night sky.

When he returned to Dallas in early 2006, another battle loomed.

As Batie was returning from Afghanistan, he learned he was being stripped of the two Subway restaurants he bought before mobilizing.

The stores were sold to Subway insiders, with one transaction yielding a Subway executive a $100,000 profit, according to a lawsuit Batie filed last year in state court in Dallas County. One issue in the case is set for trial this week.

Interesting testimonial.
There're many right here --either out of work or on the way out-- thinking of entrepreneurial opportunities. Franchises I'd guess would have to paly a huge part of any individuals plan to own their own business.

I agree. It seems as though all the Quiznos in the Ocala area are owned by the same people, though - the Footstompers, or something similar (ha ha)!

And I'm extremely envious of you (unless you get cold and snow in "Nifongville" - wherever that is, LOL!).

We had a Tubby's sub shop back home (home being Katy, Texas) that was pretty good.

Exactly. Much too high bread/filling ratio, and then on top of that, if you let them put on lettuce, much too high lettuce/protein ratio. So it’s like 75% bread to begin with, and then 75% of the other 25% is lettuce! Crap iceberg lettuce, not even the good stuff! No wonder Jared lost weight. He probably couldn’t stomach the stuff.

The "locals" around here are from Afghanistan, Pakistan and India ~ and they run several Subways. Worst of the bunch is run by this guy from India ~

The real issue here is the protection supposedly offered to returning veterans.

The old Veterans Readjustment Act (VRA) didn't happen to cover vets returning to federal jobs. The new act seems to have expanded franchisee rights a bit over the VRA's renter protection but not much.

Vets returning to federal jobs are still not protected. If promotions were handed out to everyone at your grade level with the same job and you were away, you are not going to be promoted.

Two things the Congress has never wanted are young people owning businesses and trying to make millions, nor vets getting a promotion in the federal government without first kissing some Congressman's butt.

End of story.

I used to buy Subway several years ago, but no more. I live in Florida (Jacksonville for 10 yrs. and now in Cape Canaveral). The BEST subs I’ve ever had (well, excluding the ones I’ve had in Brooklyn, NY) are from Publix. You have a choice of using prime (Boar’s Head) products or regular Publix brand. They are very patient, and will fix it exactly how you want it.

My other favorite sub place is my own home. Much cheaper as well, but I know I will like it!

I ended up losing probably $50,000 in the deal to get out from under the thumb of the Deluca mob.

I guess that was better than a homicide charge..eh?

I hate Quiznos. Nasty.

I had liked Subway until this story, but instead I will have to get the hot sandwiches at Fazolis.

Subway isn’t worth it really without their $5 foot long anyway. They only have about 5 or 6 now offered at the price, a very small selection of a couple specialty sandwiches.

I normally get a turkey, but I can’t even get a plain turkey as a $5 footlong, but I could get the idiotic cold cut combo with mystery meat that tastes nasty.

With both stores gone – and a six-figure debt load remaining – Batie sued under the Servicemembers act. The law bars anyone from terminating an active-duty service member’s installment contract, including leases, without a court order.

Interesting you should say that. About the time I left, they changed the way the sandwiches were made so they could cut down the amount of fixings in it.

For instance, used to be a foot long tuna sub had four large scoops of tuna. Now it’s three spread out over the bread. They used to demand that you put six tomato slices on any footlong. Now they put four.

Remember how they used to put U cut in the bread to make sure they could be stuffed with fixings? About 1999 when I left the company decided to just the the bread straight so employees wouldnt have enough room to fill the bread with food.

Not all that bad a price to pay for a lifelong lesson.
