Go `Birthers' go! (MSM starting to make arguments to cover Obama even if born in Kenya!)

The increasingly popular term for them is "Birthers" -- the indignant, frantic, seething fringe Republicans who are persuaded that there is strong doubt about where President Barack Obama was born and, therefore, strong doubt about the legitimacy of his presidency.

Even assuming Obama was born in Kenya despite the considerable evidence that he was born in Hawaii, that five-year provision in the law was intended, pretty clearly, to prevent a person from claiming U.S. citizenship when he was born in another country to parents who were long-time residents of that country, simply on the grounds that one of his parents was still, technically a U.S. citizen.

Say "Jim" is born in the U.S., lives here until he's 11, moves with his parents to Germany, comes of age there, marries a German woman and, when he's 25, has a child. As a matter of national policy and common sense, we don't want Jim's child to be able to claim automatic U.S. citizenship -- he is born in Germany to long-time residents of Germany. Declaring him a U.S. citizen is fundamentally absurd.

The thinking behind the law seems to be that if Jim spent at least five of his 10 years after age 14 in the U.S. before moving to Germany, he has been sufficiently "Americanized" that his children shall be considered U.S. citizens.

It's fairly clear to me and, should push come to shove, will be fairly clear to the courts and to Congress, that the law was not intended to be a "gotcha!" moment used to deny citizenship to the children of life-long U.S. citizens in their late teens who happen to be out of the country when they give birth.

Someone on another thread (wish I could remember who) was going to have post it notes made with “Where’s The Birth Certificate” printed on them.

Post them in restrooms, windshields, etc. Be creative!

I think I’m gonna try it!

The whole thing is so nutty that conservative pundit Michael Medved was quoted in Politico as wondering if the Birthers weren't, in fact, the victims of "a very big conspiracy to make conservatives disgrace themselves."

Medved having flashbacks to his Commie roots of his past Ron 'Commie Red' Dellums' days.

Two things: Michelle Obama did describe his mother as being very young and very single when she gave birth.

And the way I understand it is that the law you si cite was not the one in effect at the time of his birth. At that time, he only got us citizenship if the citizen parent had been a citizen at least 5 years after the age of 18.She had not.Anyway he would automatically get the citizenship of his father, British. If this was the case, he would also be ineligible. Basically, none of these scenarios qualify for the natural born citizen requirement.

Medved is soooooooo way full of himself- i stopped listening to him because he made my blood boil by the way he denigrates his callers. he’s a very small person who wants to be a “big player” in talk radio. trust me, he won’t rest ‘til he has day in the sun within the MSM but no one will EVER pick him up because of his background and personality.

"There should be no argument about this. The Constitution is very clear. No one but a Natural Born citizen can hold the office. The real issue is that there is no clear process for vetting the candidates to assure only Constitutionally qualified persons can be elected."Not true.

The twentieth amendment, section 3 says:

"3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

It is the job of Congress to be aware of two things concerning the "President elect". One, is he dead? 2. Did he "fail to qualify"?

If the answer to either of these two questions is "yes" then Congress must name a replacement. This means that the "President elect" has the burden of proving to Congress that he is alive, and "qualified". The string of words from section three "if the President elect shall have failed to qualify" clearly indicate that this is an action of the President elect and not the result of an action by others seeking to verify his qualifications. It is the "President elect" who shall have failed or shall have succeeded in "qualifying". One is only legally the President elect after Congress has validated the results of the electoral college votes so this "qualification" does not refer to that. There is only one set of qualifications for President to be found in the Constitution that are not health related and they are in Article two:

"No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”

Anyone serving in Congress can demand to see proof of "qualifications" by the President elect and in fact are required to do so by their oath of office from Article six. They are oath-bound to "support this Constitution" and if they are not enforcing it, they are breaking their oath of office.

So, as you can see, there is a process right there in our Constitution. If it has been enforced, then we have a right to know who did what and where the evidence is. If it hasn't been enforced, we do not have a President.
