Should illegal immigrants receive in-state tuition? (Texas)
Austin American Statesman ^ | 7.25.2009 | Melissa B. Taboada

Posted on 07/25/2009 5:41:10 AM PDT by wolfcreek

Asked whether the state can continue to grant in-state tuition to undocumented immigrants, Texas Attorney General Greg Abbott said in an opinion Friday that there's not enough legal precedent to answer the question with certainty.

Abbott said the sections of the Texas Education Code that permit illegal immigrants to pay resident tuition at state colleges and universities could conflict with federal law. But he added, "Given the paucity of judicial precedent, we cannot predict with certainty that a court would so find."

IMHO, HELL NO!

I can *almost* understand why the children of illegal immigrants should receive primary education but, that's where it should end.

Even then, these children are putting our entire education system and other public services at risk here in Texas.

Texans should really consider replacing their AG for saying such a silly thing.

Illegals are by definition not legal residents of any state, and even if someone believes that such persons should be allowed to attend a college or university in a given state, there's no way they should be granted in-state tuition because their illegal status prevents them from being legal residents of any state.

Should illegals receive free in-state tuition?

Yes! and Free Health Care! and Food Stamps! and IDs that let them vote!...

I know I shouldn’t joke, but the demands for self-destruction of the country seem endless.

"Should illegal immigrants receive in-state tuition?"

What? This is a trick question isn't it? NO! They are criminals. What they should receive is a one way ride back the the country they entered our country illegally from and either given the boot and told to never return or shot. You pick.

Look at the small print at college sites. They come right out and say residence doesn’t matter and in fact give preference to them. Imagine that. My tax dollars going to pay for a bunch of illegals who take the slots from my kids. Try searching for a scholarship for a bright middle class white kid and you’ll be wasting your time. However, there’s a flood of scholarships for illegals.

From this link...

In-State Tuition and Unauthorized Immigrant Students

In 1996, the illegal immigration reform law instituted a restriction on states' residency requirements and in-state tuition benefits for higher education, affecting an estimated 50,000-65,000 unauthorized immigrant students annually.

Last I knew that had not been repealed.

Also from the link....

The Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) of 1996 (Sec. 505) sought to prohibit states from providing a postsecondary education benefit to an alien not lawfully present in the United States on the basis of residence unless any U.S. citizen or national is eligible for the same benefit. (P.L. 104-208). The Congressional Research Service notes that there is disagreement about the meaning of the provision, and there is no guidance in congressional report language or in federal regulations.

Many colleges and universities have a limited number of places, that is, they admit only a specific number of students each year. In-state tuition for illegals inevitably denies admission to a number American citizens equal to the number of illegals admitted. Combine that with the “diversity” recruiting and you have a situation where the children of American citizens (who have paid taxes all their lives) are denied admission to the state college or university of their choice, for whom there otherwise would be be a spot. In other words, in-state tuition for illegals discriminates against American citizens.

What kind of question is that? Of course, they should NOT get in state tuition. They should not even be here. What part of illegal does the Austin Statesman not understand.

If they are going to just let them stay here and go to college, then at least let somebody in Mexico or whatever country they came from subsidize their college, not Texas taxpayers.

As soon as they go back to their country of origin, their home state should give them free tuition.

If we took our laws and sovereignty seriously, they wouldn't even be allowed to enroll in college. Citizenship or legal residence should be a requirement for admission to any college in the US.

What’s the point?

There is no benefit to Texas taxpayers, as these folks won’t be able to put their education to use for the citizens of Texas.

They’re illegal. So they can’t legally work in the U.S.

Seems simple enough to me.

Texans should really consider replacing their AG for saying such a silly thing.

How so? Sounds like a pretty accurate, wise assessment.

Texas Attorney General Greg Abbott said in an opinion Friday that there's not enough legal precedent to answer the question with certainty...."Given the paucity of judicial precedent, [and an activist judiciary,] we cannot predict with certainty that a court would so find."

Emphasis and commentary added!

Sometimes the job of a presecutor is to not bring cases that would set unwanted precedent.

If the courts were likely to rule on the law, and common sense, then it might be less problematic!

BTW, Greg...Not much in the way of legal precident until you just go ahead and cut off the spigot...

You would find a lot more support if you do, than those who would protest your action in this state...

Those that protest could be asked if it is right to reward illegal behavior...Sometimes the obvious is refreshing...

Sorry, but they ALL need to pack up and head back south. WE CAN’T SURVIVE THIS IDIOCY.

My niece is an OB/GYN who took her pre-med at HAAAAVVAAAAADDD! Needless to say, she emerged from that experience a FLAMING, BLEEDING HEART LIBERAL. (She
stopped catching babies and went into research when her malpractice premiums exceeded her annual earnings.)

Upon completing her medical training at yet another liberal university, she interned at a hospital near the border in San Diego.

It was there that a mystical transformation took place: She began to connect the heavy deductions from the slave wage GROSS EARNINGS for which she busted her butt for as many as 72 virtually sleepless hours in a row with the taxis and jalopies regularly sliding to the curb in front of the ER.

Many of them contained pregnant illegals who won the race to deliver their babies HERE. She caught many of those “anchor babies” who, under the current — and COMPLETELY ERRONEOUS —interpretation of the 14th Amendment were IMMEDIATELY NEW AMERICANS. The mother – who, obviously, could not care for the child if she were back in her native land — could not be deported now even if the INS and the political bosses WANTED her deported . And as the mother of a new US citizen, the woman could remain here for about as long as she cared to – and that was usually for life.

(NOTE: For a short, Reader’s Digest version of the ORIGINAL intent of the 14th Amendment, go here: http://pocusa.info/NLArchive22_14thAmndt.html . For a more comprehensive explanation of the events surrounding the amendment, go here: http://www.14thamendment.us/index.html )

Most of those patients were welfare recipients and the deliveries were charity cases: The bill for the hospital’s – and HER services – were routinely spread over the bills of those who DO pay. And what the other users of those facilities don’t cover went back to the taxpayers.
And since my niece was now a taxpayer, they were costing HER.

And while she may not exactly be a libertarian, today she’s now a LOOONNNNG way from Haaaavaaaaaad.

And just so the bleeders who might see this don’t think me some sort of ethnocentric bigot, I submit this problem is MORE than just about illegals.

Before my oldest daughter was born at University Hospital in Cleveland in 1967, I sat in the main lobby as welfare mother-to-be after welfare mother-to-be shuffled through the door to the maternity ER for THEIR free deliveries.

Before WE could take OUR daughter home, I had to cough up over 3 grand. And that was a great deal of dough in 1967, especially for a guy just out of the USAF.

As I wrote the check, I remembered the magazine article I’d recently read by a hospital administrator from Massachusetts who admitted that all US hospitals practiced a form of medical Marxism, spreading the costs of care for indigents over the bills of those who DO pay for care. Given the move to socialism here, it probably will never be otherwise: Not counting Byzantine complexity and confusion, government produces – and has — NOTHING unless it first takes it from some PERSON. SOMEBODY ALWAYS PAYS.

The illegals have been using the emergency rooms of our hospitals for their health-care, almost always at no charge to them. That cost is either spread over other users or the taxpayers. We have seen a national epidemic of hospital closings due to their insolvency, much of it caused by the burden of trying to render care to PEOPLE WHO SHOULDN’T EVEN BE HERE, denying care to native-born citizens who normally pay their bills and their taxes.

Look, I have a big enough problem paying for the 3rd and 4th generation slackers and welfare bums who were BORN here.

It’s time we stopped paying for those who were not.

A “good man” DOES NOT have espouse THIS bad an idea.

This crap is straight out of Saul Alinsky’s “Handbook for Radicals.” A prime technique for bringing down an existing social order is to OVERLOAD and OVERWHELM the governmental systems, creating economic and social chaos. Because we have NOT sent home 20 million illegals, WE NOW HAVE THE FORMER AND ARE CLOSING IN ON THE LATTER. BOTH parties have been applying those methods but Obama, who studied those methods under Bill Ayers while a so-called “community organizer,” is using ALL the tools in the radical toolkit. If it continues much longer, YOUR kids are doomed to life as serfs in a nation that will more resemble Nazi Germany or the old USSR than the America the Founders ATTEMPTED to leave us.

I say no. We already educate them for free through high school. If they really want to go on, they will find a way.

Here in California, we feed illegal alien children breakfast and lunch at school for free. Their parents don’t even have to feed them three meals a day. The schools fight to keep students in class every day so they’ll eat the free meals; that way we get our money from the government. Our school has even had lockdowns to keep students from walking out before lunch so we won’t lose our government funding for that day.

If a high school girl becomes pregnant, we allow her to stay in class, provide her meals, give her free prenatal care, and give her free daycare on campus after the baby is born.

It won’t surprise you to learn that we have a large percentage of teen pregnancies on our campus.

You have to go back to Judge Wayne Justice's original decision, and how the CA judges used his Texas decision to overturn Prop 187.

He was appointed by LBJ, and is now in his 90s, but still is semi-active there in Tyler, recently ruling that Texas's bi-lingual education program was inadequate.

He is also the judge who made the original decision on prison overcrowding.
