Should illegal immigrants receive in-state tuition? (Texas)

Asked whether the state can continue to grant in-state tuition to undocumented immigrants, Texas Attorney General Greg Abbott said in an opinion Friday that there's not enough legal precedent to answer the question with certainty.

Abbott said the sections of the Texas Education Code that permit illegal immigrants to pay resident tuition at state colleges and universities could conflict with federal law. But he added, "Given the paucity of judicial precedent, we cannot predict with certainty that a court would so find."

If an invading criminal hands a school enough money for tuition, the school should be required to use that money to buy handcuffs, chain them to a bus seat, and hand the driver the key and a paid one-way ticket back to where they came from.

You have to go back to Judge Wayne Justice's original decision, and how the CA judges used his Texas decision to overturn Prop 187.

He was appointed by LBJ, and is now in his 90s, but still is semi-active there in Tyler, recently ruling that Texas's bi-lingual education program was inadequate.

He is also the judge who made the original decision on prison overcrowding.
