The only confusion as to the intended, original meaning of the term "natural born citizen" arises from deliberate obfuscation created by a tortured interpretation of the 14th Amendment. The 14th Amendment dealt with extending the rights and obligations of citizenship to former slaves. It did not and does not, however, alter eligibility requirements for the office of President.

I beg to differ. English common law, as stated by Blackstone and other 18th century authorities, followed the jus solis, under which anyone born in England was a natural-born subject even if both parents were aliens. Vatel's Law of Nations takes a different view, but that is (as the title itself makes clear) because Vatel's book was about European law, not English common law. The U.S. Constitution has always been interpreted in light of the common law.

The U.S. Supreme Court has never decided a case about a presidential candidate's eligibility under the Natural Born Citizen clause, but there are statements in many Supreme Court cases (Wong Kim Ark v. United States is only one example) that there are only two kinds of U.S. citizens-- natural born and naturalized. That would mean that someone born in the U.S. is a natural born citizen.

Most importantly, from a practical point of view: Obama has always stated that his father was not a U.S. citizen. When he ran for president, no one-- no primary opponent, no general election opponent, no member of Congress from either party, no election official in any state, no judge, no law professor-- ever suggested that this disqualified him from office. So there is no way in hell any court is going to undo an election based on the theory that facts Obama publicly disclosed before the election disqualify him. (Proof that he wasn't born in the U.S. might be a different matter, but his non-citizen father-- no way.)

Could the August 19 have been a registration date for extension courses or correspondance courses? They wouldn’t necessarily follow the same schedule as regular classes. At least, they didn’t at Berkeley. I thought it might be necessary for me to take a correspondance course one summer when I was at Berkeley during that same time period. I remember that I had to apply for permission to do so — done by mail. After I was approved, I had to come up with tuition, send for materials, etc. As it turned out, I didn’t take the course, after all, but that was the procedure.

Might well have been a registration date--I assume it was. Although there is a letter around from the University that says she was registered as an extension student.

And the actual class schedule for night school may have been a two days off the undergraduate quarter--may not. In no event before the last Monday in September.

But I am here to tell you almost bulletproof, there were no on campus attendance classes in process on August 19--night classes; day classes; or anything else.

Yes, but the baby had to be listed on the parent's passport. No way the State Depatment would do that for a baby who wasn't a citizen (as Obama would not have been had he been born overseas).

Not that I know of no. As late as the 80's; nobody ever said anything to me about listing my kid on my passport.

I know that is done now--my sister had her kids on hers. But in the earlier period, I never heard of it. I traveled all over the world and saw lots of babies and little kids.

I travelled on my mother’s passport as a child in the 1960s, but she had to have me added to her passport at the Passport Office.

If she flew the route mentioned earlier, she flew into Canada and would just have to ride the ferry, or drive across the border with the baby....No big deal. David did the research and posted the flight plan for the year 1961. back in the thread...

I'm not the person who did the research--I was surprised to find the original schedules were still available. Nullie may know who it was or may have been the person who did the work.

And, not the ferry--you are thinking about Victoria. The common route in 1961 was by car from Vancouver International to Seattle.

Unfortunately, the military appears already to have punted. Officers sign an oath to defend and protect the constitution. They are well aware that there is at least uncertainty about Obama’s eligibility. If we take Obama at his word, his father is an alien. The Supreme Court is a court of appeals. We appear to have a legal system without the integrity, or courage, to take a case. They hide behind protocol. It is appearing more and more as if saving the constitution will be up to “The People”. That is probably why Obama has announced his intention to create a civilian army, as large and well-funded as our existing federal army. It is becoming more clear, as our long term unemployment moves past 15 percent, and other economy fails, that the source of the civilian army, already assigned to public hearings, will come from the SEIU, and other unions who will not find other than government jobs when federal "revenue" (I hate that double speak) is down 57%.

Obama is probably a Title 8 citizen, though he has never applied for naturalization, though there is even doubt about that. If he was born in Hawaii he is a citizen, but can never be natural born. The most unassailable verification of that fact is the edit of the Constitution made between the June 18 draft and the July 25 suggestion to G. Washington by John Jay that the president's requirements be strengthened to require a natural born citizen. It was all about allegiance, and discussed at length by Madison in The Federalist Papers.

My parents were in Germany in the early sixites(Dad stationed there in the Army). My sister was born there and all my mom used was my sister's Birth Certiicate to fly her back to the States. She was not on her passport at that time.
