As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.s children.

Furthermore: Hawaii's Territorial Law, Chapter 57 - "VITAL STATISTICS, I", shown beginning pg 23 of 29, (the law in effect in 1961) allowed baby's born anywhere in the world to be eligible to apply for a Hawaii birth certificate.

Of course, all of this ignores the Constitutional requirement that all revenue bills originate in the House. It makes it tough - and by tough, I mean unconstitutional - for the House to adopt the Senate bill with it containing so many provisions that increase revenue to the treasury, namely the so-called "Cadillac" tax.
Almost immediately, this law would be challenged in court, leaving the only question of "How much would the court strike?" Would they strike the entire bill, or would they strike just the revenue portions, which would probably be more likely. That could theoretically leave all the new insurance regulations, and the individual mandate intact.
