Much of the focus on the stalled ObamaCare effort comes from the opposition of Blue Dog Democrats to the removal of the Stupak amendment in the Senate bill, allowing for federal abortion funding if Congress fails to renew the Hyde Amendment. The rest of the attention has gone to the changes being made in a parallel bill, one that the Senate will use reconciliation to pass to resolve disputes between the House and Senate over taxation and budgeting. Those arent the only changes being contemplated, however, as the AP reports:
"A Democratic aide says a new provision in the health care bill will require businesses to count part-time workers when calculating penalties for failing to provide coverage."
"The bill originally passed by the Senate only penalized businesses for full-time workers who werent covered. The Senate bill is being used as the basis for a final package President Barack Obama wants Congress to pass in the next few weeks."
I.E. A tax grab for businesses that hire extra help during the Christmas season.

This does not matter because it is not the original Senate bill the House will have to vote on. Obama will then sign the Senate bill.
The things mentioned in the article have to be on a separate bill to come later.
Also the Senate may never approve this new bill.
The days of calling employees “independent contractors” are over.
In order for someone to be an independent contractor they need a federal tax id number, their own comp and liability insurance and need to fulfill a number of other requirements.
If you get audited, which you will since it is a big fundraiser for the government nowadays, they will go back 7 years and charge you for SS withholding, State withholding, workers comp insurance and unemployment insurance taxes. You will most likely go out of business and since these obligations can’t disappear with bankruptcy you will be broke personally also. I’ve had several competitors disappear due to these audits.

Is that only in certain states? Lots of 1099 activity here and I doubt many of them have done all that.
BAD IDEA....there is an IRS checklist of some 12+ requirements to classify someone as an independent/sub contractor instead of an employee. If you are ever called up on audit (and declared subs often FLAGS you for audit), you’ll get SLAMMED by the IRS for classifying subs as employees if you FAIL only ONE ITEM on their checklist.
Can you say “penalties, interest,” or perhaps “jail time” and “loss of your business?”
Remember, with the IRS, you are guilty until proven innocent and the burden of proof is ALWAYS on you.
And IRS employee's are in shock, SHOCK! when folks fly planes into their buildings.

Much of the talk following Obamas announcement has focused on how to defeat this second bill through reconciliation, but that is misleading because the first step to defeating Obamacare is not by concentrating on defeating the fixer bill but by defeating the Senate bill in the House when it goes to the floor for an up-or-down vote on Thursday, March 18th.
