The passage of PPACA (Obamacare) begs a legal challenge of Obama's legitimacy to sign the bill in the form of a quo warranto action, as this Nevada candidate is advocating. I'm not a lawyer, but I suspect that every state governor and AG has potential standing to challenge Obama with quo warranto due to the numerous injuries to a state that can be claimed to result from the bill. This would be in addition to the obvious potential Commerce Clause violations in the bill.

And so it begins. It cannot help but begin now.

The investigation began after Metropolitan Police on March 25 pulled over Mr. Harris in Southeast on suspicion that the windows of his vehicle were tinted too darkly.
After searching Mr. Harris and his vehicle, police found marijuana and 21 credit cards that were not issued in his name or the name of a female passenger with him. Police also found eight printouts of State Department passport applications, and four of the names on the applications matched four of the credit cards.
Upon questioning by agents from the U.S. Secret Service, U.S. Postal Service and State Department, Mr. Harris “admitted he obtained the passport information” from a State Department employee, court documents say.

Mr. Harris also said the fraud ring submitted credit-card applications using the names and “identifying information” of the persons listed on the passport applications, and that a postal service employee then would intercept the cards before they were delivered to the appropriate residences.
Then, on April 17, 2008, Lt. Harris was found fatally shot dead slumped over the steering wheel of his car in front of the Judah House Praise Baptist Church in Northeast DC."

In the State of Hawaii, back in 1961, there were four different ways to get an “original birth certificate” on record.
BC1. If the birth was attended by a physician or mid wife, the attending medical professional was required to certify to the Department of Health the facts of the birth date, location, parents’ identities and other information. (See Section 57-8 & 9 of the Territorial Public Health Statistics Act in the 1955 Revised Laws of Hawaii which was in effect in 1961).

BC2. In 1961, if a person was born in Hawaii but not attended by a physician or midwife, then all that was required was that one of the parents send in a birth certificate to be filed. The birth certificate could be filed by mail. There appears to have been no requirement for the parent to actually physically appear before “the local registrar of the district.”
It would have been very easy for a relative to forge an absent parent’s signature to a form and mail it in.
In addition, if a claim was made that “neither parent of the newborn child whose birth is unattended as above provided is able to prepare a birth certificate, the local registrar shall secure the necessary information from any person having knowledge of the birth and prepare and file the certificate.” (Section 57-8&9)
.... there is and was no requirement for a physician or midwife to witness, state or report that the baby was born in Hawaii.

BC3. In 1961, if a person was born in Hawaii but not attended by a physician or midwife, then, up to the first birthday of the child, a “Delayed Certificate” could be filed, which required that “a summary statement of the evidence submitted in support of the acceptance for delayed filing or the alteration [of a file] shall be endorsed on the certificates”, which “evidence shall be kept in a special permanent file.”
The statute provided that “the probative value of a ‘delayed’ or ‘altered’ certificate shall be determined by the judicial or administrative body or official before whom the certificate is offered as evidence.” (See Section 57- 9, 18, 19 & 20 of the Territorial Public Health Statistics Act in the 1955 Revised Laws of Hawaii which was in effect in 1961).”

BC4. If a child is born in Hawaii, for whom no physician or mid wife filed a certificate of live birth, and for whom no Delayed Certificate was filed before the first birthday, then a Certificate of Hawaiian Birth could be issued upon testimony of an adult (including the subject person [i.e. the birth child as an adult]) if the Office of the Lieutenant Governor was satisfied that a person was born in Hawaii, provided that the person had attained the age of one year.
(See Section 57-40 of the Territorial Public Health Statistics Act in the 1955 Revised Laws of Hawaii which was in effect in 1961.)
In 1955 the “secretary of the Territory” was in charge of this procedure. In 1960 it was transferred to the Office of the Lieutenant Governor (“the lieutenant governor, or his secretary, or such other person as he may designate or appoint from his office” §338-41 [in 1961]).

In 1982, the vital records law was amended to create a fifth kind of “original birth certificate”. Under Act 182 H.B. NO. 3016-82, “Upon application of an adult or the legal parents of a minor child, the director of health shall issue a birth certificate for such adult or minor, provided that the proof has been submitted to the director of health that the legal parents of such individual while living without the Territory or State of Hawaii had declared the Territory or State of Hawaii as their legal residence for at least one year immediately preceding the birth or adoption of such child.”
In this way “state policies and procedures” accommodate even “children born out of State” (this is the actual language of Act 182) with an “original birth certificate on record.”

I hope to God I was wrong... and this is a good sign.

It’s my understanding it would not matter if he were born in the Oval Office he is not a “Natural Born” citizen. Both his parents were NOT citizens and it’s my understanding to be a “Natural Born” citizen both parents had to be citizens. Hawaii is a smoke screen and always has been.......

This “demand” has no meaning. Legally, the writer has no standing or authority to make such a demand of the sitting Governor of Nevada.

While I agree that the Governor and State AG’s have numerous grounds to challenge the Constitutionality of ObamaCare, they don’t have to resort to the birther issue to make their case. SO many obvious problems exist to attack, why pull in one that, whether one likes it or not, will get them labeled as kooks, and their arguments ignored, ridiculed, or worse?

What kind of patriot dedicated to defending the constitution and confirming Obama’s eligibility would have the slightest concern about name calling? Well, now that you mention it, nearly 100% of elected officials so far...

Yet this bill will screw so many people personally providing them standing under the “particularized injury in fact” requirements potentially supporting quo warranto claims not unlike Donofrio’s Chrysler dealers, should he get around to it.

If Obama has nothing to hide, what is the harm in submitting to discovery and why the ridicule of those who demand it?

Obama has pissed off so many powerful people that birtherism could suddenly become very appealing to at least some of them.

Most recently a whole lot of Jews including Jewish lawyers who voted for Obama have become enraged at his treatment of Israel and may be desperate to remove him before the end of his term before Iran gets the bomb or Israel has to cede huge chunks of Jerusalem to the PA. I guarantee you that some of them have begun to research quo warranto as I type this, judging from Ed Koch's scathing denunciation of Obama in an editorial today!

I was in no way ridiculing anyone, Seize. I was making a strategic suggestion, offering an alternative approach, putting forth a constructive criticism so that we might avoid some of the pitfalls and obstacles to achieving our mutual goals.
