Sen. Robert Byrd, the longest serving senator in U.S. history, is in serious condition in a Washington area hospital, according to aides to the West Virginia Democrat.
According to a statement from Byrds staff released Sunday afternoon, the senator was admitted to the hospital late last week suffering from what was believed to be heat exhaustion and severe dehydration as a result of the extreme temperatures. He was expected to remain in the hospital not more than a few days.
The statement added: However, upon further examination by his doctors, other conditions have developed which has resulted in his condition being described as serious.
Byrds office did not say which hospital he was in, although Byrds doctors described his condition as seriously ill.

But I need help understanding the provision. “....if the unexpired term of any other office named in this section is for a period of less than two years and six months, the appointment to fill the vacancy is for the unexpired term. If the unexpired term of any office is for a longer period than above specified, the appointment is until a successor to the office has timely filed a certificate of candidacy, has been nominated at the primary election next following such timely filing and has thereafter been elected and qualified to fill the unexpired term.”
Hasn’t the West Virginia primary election already been been held? Even if there’s a run off primary (I have no idea if there is), isn’t it likely that the time frame for “timely” filing of a certificate of candidacy for the 2010 primary election has already passed?
Another question: Was the quote above “before” or “after” the amendment made in 2009 session that you refer to?

I’m not familiar with the WV statutes. I just posted from their site. But my understanding would be if the term of the replacement is less than 2 1/2 years then the gov appoints for the remainder of the term with no interim election. If greater than 2 1/2 years then the appointment would be until an election could be held. The date for the 2 1/2 years would be this coming Jul 3, 2010 I believe. Sen. Byrds current term expires Jan. 3, 2013.
I’m assuming the quoted statute is what’s in effect today but I don’t know. It’s what’s on the their state web site.
If he hangs on for another week or so, the Gov has to go full boogie and hold an election vs. an appointment?

State-wide, Nan. WV Senator and US Representative are not state-wide offices. The last state-wide office held by the GOP was Sec. of State Jill Ireland.
I think I just found the answer to my question to you about the timely filing of a certificate of candidacy. There was a 1994 West Virginia Supreme Court Case, No. 22310, that seems to have addressed a similar situation. That case involved a judge who died in 1994, before the May 1994 primary, but after the time for filing a certificate of candidacy. The Republicans wanted the vacancy to be filled at the next general election. They lost.
He is 92 years old. A cool draft could kill him at this point.

No just the reverse. If the vacancy occurs within 2 1/2 yrs of the end of the term the gov. appoints. It’s only if the vacancy is longer than 2 1/2 yrs that an election is to be held. Just my reading.

That’s the way I read it also. On the other thread I said he had ‘till Thursday....I was wrong. He has ‘till Saturday. I thought the new Congress was to be seated on 1/1/11 instead of 1/3/11
