A Vote for Kagan Is a Vote to Take Away Your Guns

With those words in mind, alarm bells should have gone off during Elena Kagan’s confirmation testimony to the Senate Judiciary Committee on Tuesday. Here’s what Kagan told Sen. Charles Grassley (R-Iowa):

It has long been thought, starting from the “Miller” case, that the Second Amendment did not protect such a right. . . . Now the Heller decision has marked a very fundamental moment in the court's jurisprudence with respect to the Second Amendment. And as I suggested to Senator Feinstein there is not question going forward that ‘Heller’ is the law, that it is entitled to all the precedent that any decision is entitled to and that is true to the ‘McDonald’ case as well...

There are two big problems with Kagan’s remarks: she inaccurately describes the 1939 "Miller" case and her claims to follow stare decisis are meaningless. . . .

For a vote such as this, any respectable pro-2A organization should immediately grant a permanent, irrevokable “F” grade to any senator who votes to confirm such a nominee, regardless of any previous votes on gun rights.

True story: My daughter is in the hospital with pneumonia (She’s doing well). Among the screening questions the RN asked my wife and I was this:

“Do you have a gun at home?”

I answered: “Not yet - but thankfully my wife and I recently obtained are ‘License to Carry’ permits and we’ll soon remedy the situation...”

The look on her face was priceless.

my favorite “for the stupid people” question is the stare decisis red herring. The supreme court is not bound by its own stare decisis.

I don’t care for this woman either,but isn’t she replacing another democrat that votes against all that is good..I don’t think it will be much different if she wins or loses..Maybe I am wrong..She is a bad Oman as far as that goes..She can’t over turn the gun bill that the court just passed on her own..only if Obama is able to take a conservative seat on the bench..will the liberal morons be able to take this country down to their level..

Leftist demrats have been at this for years now. Many doctor and dentist offices have the question on that form you have to fill out when you visit them. The best response is no response. To wit: Do not say you have, have not and/or are getting a gun. None of their business.

You’re right - I should have said nothing but I couldn’t resist the urge to boldly proclaim my rights. Probably on a watch list to be sure, but then again, I’ve been a Freeper for a decade!

pose. Just what organization or individual argued
in favor of gun control during the development of
the US Constitution? Or, on what basis did the
founding fathers decide that weapons should only
be in the hands of militia members? What was the
nature of the gun control lobby?

In fact, a few of us are well aware that in
Federalist 46 James “Father of the Constitution”
Madison boasts that unlike Europeans, the Americans
own their own weapons. What is so hard to under-
stand about it?

I would have said "Of course. In my 2 story 4 bedroom house, you are never more than five steps away from a gun and they are all loaded and unlocked (or else they aren't much use now are they). In fact, as a concealed carry permit holder, I carry a loaded gun about 90% of the time (only except where prohibited) and I might just be carrying a loaded gun on me right now."

I'd like to see the look on her face after that.
