Walker keeps talking about no requirement that marriage partners procreate. He has engaged in a bit of sleight of hand: the issue is the ability potentially to procreate. That ability simply doesn’t exist with gays.

If it’s xx’s and xy’s, then there’s the potential to procreate. If it isn’t, then there no potential to procreate.

(And please don’t someone start talking about xxxy’s and the like. It is purely a diversion.)

He also claims that marriage in the US has always been a “civil” issue and that the religious is inconsequential, that the state simply extends an authority to “solemnize” marriages, but that the state’s in control.

That simply isn’t so in colonial and pioneer America. The issue was not some “civil” licensing agency. Generally, it was a preacher, a couple, and wedding vows. Those folks were married, and it had NOTHING to do with civil authorities.

They simply assumed record-keeping duties for tax, inheritance, and power reasons.

Vaughn’s so-called “findings of fact” need serious scrutiny. His wording is suspect in some, and his actual finding in others.

We need a thread that posts each of the facts once we get past about #15 — all of those being about parties to the case. A huge forum such as FR should be able to dissect those facts and show the bias in so many of them.

Not only is his decision in itself harmful and injurious to society, it sets a legal precedent - a precedent that a legal marriage is NOT retricted to a union between a male and a female.

The corollaries to this are horrific. Beastiality, polygamy and polyandry come to mind.

Especially in our current state of siege by Islam, polygamy is a serious threat.

Once upon a time, Lebanon was mainly a Christian Nation.
Then, large numbers of Palestinian, Syrian and other Muslims started moving in. They quickly outnumbered the Native Christian Lebanese, forcing many to flee and, in effect Islamicized the Country. Polygamy was one of their “tools” - a very significant one.

Ask Brigitte Gabriel, a Lebanese Christian. She lived there when it was going on and now has here own website in America directed at this menace.

The comforting this is that this decision will be appealed to SCOTUS. Just hope and pray that Justice Kennedy votes with ROberts, Scalia, Thomas and Alitto. We KNOW which way the four freaks, Bader-Ginsberg, Soto-Mayor, Kagan and Breyer, will vote.

God' s path for civilization is specified by God's Law for civilization, and that law forbids (among other things) sodomy and prenatal child-murder.

Over 40 years ago, Pope Paul VI noted that the acts which are offenses against the transmission of life --- he singled out contraception--- could kill marriages, families, nations, and civilizations.

Europe, Russia, Japan, Taiwan, and some other areas now have such a shriveled rate of reproduction that they will not survive as national entities over the next 50 years. We in the USA are just on the edge of demographic senescence and decline, propped up only by immigrants and the first-generation children of immigrants.

Will we go the way of Europe? Probably. Adios.

Judge Walker declares that "Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license." This, he contends, is wrong because marriage is a basic right.

However, one has a "right" or is "free" to marry only in so far as one is capable of being married. One does not have a right to a vocation in life that one cannot perform the duties of. Does one have the "right" to be a fireman if one cannot quickly climb a ladder and lift a heavy hose? Does one have a "right" to serve in the military if one cannot physically meet its demands?

We may think the above is a valid argument, but it has been legally established that it is not. Standards have been lowered so that women can compete with men. The liberal and homosexual agendas are making what is right and natural anything but, and we are coming to the end of life as we have previously known it.

Only in today's America could a homosexual judge be allowed to overturn a law such as this. More is coming, and very quickly, if we can't get some conservatives into office in the next elections.

I wonder how many people realize that the laws and court rulings allowing homosexual “marriages” make polygamy a virtual certainty.

Thank you for the information on Brigitte Gabriel and the link to her web site. I practice my faith in a Maronite (Eastern) Catholic Church which has its seat in Lebanon. Many of our parishioners fled Lebanon but go home to visit family each summer. My pastor’s brother is a General in the Lebanese Army. Three years ago, he was nearly killed while fighting Hezbollah. A round of fire penetrated the one section where his body armor met. Lebanon is the last “christian” nation in the Middle East.

There will not be a rush of homosexuals getting married. It’s not going to happen. There’s like 36 million married couples in California, of which 16,000 are homosexuals.

FWIW, in addition to producing the next generation of a society marriage has provided some contractual stability for the spouse and children which also benefits society. Unfortunately, we now live in a society where feelings are more important than reason.

There is no reason for homosexuals to marry one another. Every protection they want can already be done. It's because they want people to think their lifestyle is happy, healthy and normal.

Mark Stein wrote a great book about demographics called America Alone. I highly recommend it. Demographics are destiny. Marriage is critical to a growing society because in most cases it produces children.
