Man punches TSA screener at Indianapolis International Airport

A Connecticut man was arrested at Indianapolis International Airport Tuesday after punching a TSA screener.

John Christina, 51, Simsbury, Conn., allegedly exchanged words with and then punched a TSA screener at a security check point.

According to police, he was charged with misdemeanor battery.

No, judges cannot turn citizens into chattel. Using your own arguments there is no law or precedent for them to do so.

It does NOT refer to property, nor to person, except indirectly through the understandings of what slavery, servitude and party means.

Slavery is one form of property - a form which this Amendment abolishes.

Nor does it revoke the precedents in law (aka "legal precedent") established by which men may be treated like property.

Actually, that's precisely what it does and what it was meant to do: erase 76 years of legal decisions that rested on the assumption that human beings could be property.

That ignores the reality. It has already happened. Citizens traveling by airlines are now treated like chattel. Judges have okayed it.

Fine... if we are standing in line at the airport, we are no longer people, but the property of the U.S. I guess I won’t protest too much unless the government begins selling us at public auction.

I have. I travel Sacramento to Burbank several times a month and since about September the general tenor of the TSA people at Burbank (but not Sacramento) has become more aggressive and they act more like a cop interrogating you on the assumption that you’re guilty. When I get done with them I almost feel as if I’ve evaded a criminal accusation. With the new GropeFest policy I’ve informed my employer that any future travel will be 1) on the train 2) in my personal car. I love Southwest Airlines and I’m sorry not to do business with them, but it’s not worth it to me.

The other article about the poor woman humiliated by the TSA...ripping her blouse down and laughing at her breasts? If it had been me? A proverbial polite slap in the face of the TSA Agent(s) was required. Arrest me for it.

Ditto. But do you know what else I would have done when they started laughing???? I would have given them an evil laugh back, grinned, and said, "Thanks guys. You've just made me a very rich woman." Then I would have sued them for everything they own.

Title 18, U.S.C., Section 242 - Deprivation of Rights Under Color of Law

This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.

This law further prohibits a person acting under color of law, statute, ordinance, regulation or custom to willfully subject or cause to be subjected any person to different punishments, pains, or penalties, than those prescribed for punishment of citizens on account of such person being an alien or by reason of his/her color or race.

Acts under “color of any law” include acts not only done by federal, state, or local officials within the bounds or limits of their lawful authority, but also acts done without and beyond the bounds of their lawful authority; provided that, in order for unlawful acts of any official to be done under “color of any law,” the unlawful acts must be done while such official is purporting or pretending to act in the performance of his/her official duties. This definition includes, in addition to law enforcement officials, individuals such as Mayors, Council persons, Judges, Nursing Home Proprietors, Security Guards, etc., persons who are bound by laws, statutes ordinances, or customs.

Punishment varies from a fine or imprisonment of up to one year, or both, and if bodily injury results or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined or imprisoned up to ten years or both, and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

We don't need Soviet Style action to fix the problem, but if we:

Seal up the border
Profile
Use the full weight of our intelligence apparatus to target bad actors within our borders
Ensure bad guys are put away and stay away
Restrict immigration from certain places
Scrutinize travelers from very specific areas even more
Have a brief interview process for all passengers as the Germans use to do and the Israeli's still do
......Many more.......

We wouldn't have these issues. NOTHING the TSA does will really work stand alone and static since the bad guys are analyzing, probing and coming up with ways to get around these security processes and technologies. Real security is provided “behind the curtain” with good intel and law enforcement work. All these actions like scanners amount to a reactionary effort that can in reality be circumnavigated all together. But it makes the public “feel” secure and we are a society that believes in magic pill solutions for everything.

Profiling- With the exception of the leftist terrorist types that faded from the scene in the late 80s/early 90s Most hijackings, literally 90% have been from people of an Islamic/Muslim origin and yes profiling would have worked.

In fact, even the so called “home grown” terrorists are those that usually would trip alarm bells if profiling because they either are the wacko types that grow a beard and wear their man dresses, or they are of Somali origin etc........ While you're certainly right that profiling can be defeated by a savvy foe and that it's never a 100% accurate science, it surly can be helpful and should not be looked at as a static and superficial screening, but rather a dynamic and intel driven process that is adapting to the threat. Those minimizing profiling are essentially looking at this process in an overly simplistic and static manner.

But in the end, NOTHING you do at the airport will really work, the real emphasis needs to be elsewhere.
