WASHINGTON—Emerson Winfield Begolly, 22, of New Bethlehem, Pa., was indicted by a federal grand jury in Alexandria, Va., today for allegedly soliciting Islamic extremists to engage in acts of terrorism within the United States and posting bomb-making instruction materials online.
The indictment was announced by Neil H. MacBride, U.S. Attorney for the Eastern District of Virginia; Lisa Monaco, Assistant Attorney General for National Security; James W. McJunkin, Assistant Director in Charge of the FBI Washington Field Office; and David J. Hickton, U.S. Attorney for the Western District of Pennsylvania.
“Emerson Begolly is accused of repeatedly using the Internet to promote violent jihad against Americans,” said U.S. Attorney MacBride. “These allegations demonstrate how young people in the United States can become influenced by – and eventually participate in – jihadist propaganda that is a serious threat to the safety of us all.”
“Today’s case underscores the continuing threat posed by homegrown extremists seeking to use the Internet to incite violence,” said Assistant Attorney General Monaco.
“Today, the FBI is faced with a complex threat environment that combines homegrown extremism and the Internet,” said Assistant Director in Charge McJunkin. “The FBI’s top priority is stopping terrorism, and we remain vigilant against those who solicit violent acts in the United States.”
“Those who attempt to harm or kill Americans will face a determined, coordinated law enforcement effort,” said U.S. Attorney Hickton.
According to the two-count indictment, Begolly has been an active moderator of a popular, internationally known Islamic extremist web forum, the Ansar al-Mujahideen English Forum (AMEF), used by its members to promote and distribute jihadist propaganda. The indictment alleges that since July 2010, Begolly has placed a number of postings encouraging attacks within the United States, including the use of firearms, explosives and propane tanks against targets such as police stations, post offices, synagogues military facilities, train lines, bridges, cell phone towers and water plants.
Following the reported shootings in Northern Virginia at the Pentagon and the Marine Corps Museum in October 2010, Begolly allegedly posted a comment online that praised the shootings and hoped the shooter had followed his previous postings encouraging similar acts of violence that might “seem small but cause big damage.”
On Dec. 28, 2010, Begolly allegedly posted links to a 101-page document that contains information on how to set up a laboratory, conduct basic chemistry and manufacture explosives.
The indictment charges Begolly with solicitation to commit a crime of violence, which carries a maximum penalty of 10 years in prison, and distribution of information relating to explosives, destructive devices and weapons of mass destruction, which carries a maximum penalty of 20 years in prison.
On Feb. 2, 2011, Begolly was indicted for allegedly assaulting federal agents and firearms-related charges in the Western District of Pennsylvania. He faces a maximum sentence of life in prison if convicted of the charges filed in that district.
Criminal indictments are only charges and not evidence of guilt. A defendant is presumed to be innocent until and unless proven guilty.
This case is being investigated by the FBI Washington Field Office. Assistant U.S. Attorney Neil Hammerstrom of the U.S. Attorney’s Office for the Eastern District of Virginia’s National Security and International Crime Unit, Assistant U.S. Attorney James Kitchen of the U.S. Attorney’s Office for the Western District of Pennsylvania, and Trial Attorney Stephen Ponticiello of the Counterterrorism Section in the Justice Department’s National Security Division are prosecuting the case.

The plea was announced by David J. Hickton, U.S. Attorney for the Western District of Pennsylvania; Neil H. MacBride, U.S. Attorney for the Eastern District of Virginia; Lisa Monaco, Assistant Attorney General for National Security; James W. McJunkin, Assistant Director in Charge of the FBI’s Washington Field Office; and Michael A. Rodriguez, Special Agent in Charge of the FBI’s Pittsburgh Division.
“Too often prosecutions arise only after a perpetrator commits actions ending in tragedy,” said U.S. Attorney Hickton. “On this occasion, I commend the FBI for taking proactive steps to protect the people of the United States before any such tragedy could occur. I am proud of the coordination and cooperation of the various offices involved in this investigation in bringing Mr. Begolly to justice efficiently.”
“Jihadist propaganda on the Internet is a serious threat to our safety, and today’s plea is the latest example of our office’s efforts to aggressively identify and prosecute homegrown terrorists,” said U.S. Attorney McBride. “Extreme radicalization can happen anywhere, and this case underscores the need for continued vigilance against homegrown terror threats.”

“On a daily basis, Americans are faced with a complex threat environment that includes homegrown extremists who use web forums to share information and incite violence,” said Assistant Director in Charge McJunkin and Special Agent Charge Rodriguez. “As this case unfolded, the FBI in Washington, D.C. and Pittsburgh, in close coordination with the Department of Justice and U.S. Attorney’s offices in Pittsburgh and Alexandria, Virginia, worked quickly and effectively to eliminate the threat against U.S. citizens.”
According to information presented by the government in court, Begolly was an active administrator on the Ansar al-Mujahideen English Forum (AMEF), which is an internationally used Islamic extremist Internet forum. Using the pseudonym of Abu Nancy, Begolly systematically solicited jihadists to use firearms, explosives and propane tanks against targets such as police stations, post offices, Jewish schools and daycare centers, military facilities, train lines, bridges, cell phone towers, and water plants.
In the summer of 2010 Begolly urged jihadists on the AMEF to “write their legacy in blood.” Begolly promised a special place in the afterlife for violent action in the name of Allah. Following the reported shootings in Northern Virginia at the Pentagon and the Marine Corps Museum in October 2010, Begolly posted a comment online that praised the shootings and hoped the shooter had followed his previous postings encouraging similar acts of violence. On Dec. 28, 2010, Begolly further solicited his AMEF audience to violence by posting a manual on how to manufacture a bomb.
Days later, on Jan. 4, 2011, FBI agents were assaulted by Begolly as they attempted to prevent him from reaching a loaded 9 mm semi-automatic handgun, which he had concealed on his body. While violently struggling with the agents, Begolly bit the agents on their fingers in an attempt to free himself to reach his firearm. His actions are consistent with a posting in which he urged his audience not to be taken alive by law enforcement, to always carry a loaded firearm, and to aggressively resist any law enforcement encounter including biting fingers if necessary.
Senior U.S. District Court Judge Maurice B. Cohill scheduled sentencing for Nov. 29, 2011.
These cases are being investigated by the FBI Washington Field Office and the FBI Pittsburgh Field Office. Emerson Begolly, 22, faces up to five years in prison when he is sentenced in late November. His plea agreement is sealed, but according to the indictment, Begolly made a series of posts on the Ansar al-Mujahideen English-language forum starting in July 2010 which urged people to carry out terrorist attacks in the United States. He suggested targeting “police stations, post offices, synagogues, military facilities” and utilities.

Begolly bit two FBI agents who tried to question him in January regarding his online solicitations. He also tried to draw a loaded handgun, which seemed to match the aggressive message in his Ansar al-Mujahideen posts.
“Peaceful protests do not work,” he wrote. “The kuffar see war as a solution to their problems, so we must see was as the solution to our[s]. No peace. But bullets, bombs and martyrdom operations.””

SNIPPET: “Emerson Begolly, 22, of Redbank pleaded guilty in a Downtown courtroom to soliciting terrorist acts on a pro-jihad website and carrying a firearm during a scuffle with federal agents in January.
In an unusual move, U.S. District Judge Maurice Cohill sealed the plea agreement, on a joint request from U.S. Attorney David Hickton and Assistant Federal Public Defender Marketa Sims. Neither would discuss the terms of the agreement or the reason for the seal. The judge declined comment on why he agreed to the seal.
“The most frequent reason for (a seal) is that there is an ongoing investigation or informant relationship, or he’s giving assistance to the government,” said David Harris, a University of Pittsburgh law professor who studies federal criminal procedures.
Because this is a terrorism case, the seal could mean the document has national security information ...”

SNIPPET: “Mohammed’s chat room friend was Emerson Begolly, a Pennsylvania State University student who was soon charged with soliciting unrelated terror attacks. Transcripts of the chats were publicly filed in that case.
During the Nov. 22, 2010, chat, Mohammed told Begolly he lived near National Security Agency headquarters in Fort Meade, Md.
“The place where I live is a HOTBED of NSA and all the security agencies of Amrika (sic),” Mohammed wrote. “And the kids who study in my school proudly state that their parents work in NSA and FBI, and even carry key chains - piss me off.”
“Like Columbine?” Begolly asked.
“Na’am, lol” Mohammed wrote, using the Arabic word for “yes” and Internet slang for “laughing out loud.””
