To win a request for stay, you have to show four things:

1. Irreparable harm will be caused to the person seeking the stay.
2. Likelihood of success on the merits.
3. No harm to other parties.
4. The public interest will be served by granting the stay.

The Illinois Supreme Court is not as crooked as it might otherwise appear. First, there are three republicans on it, including a former Notre Dame football hero, Bob Thomas. Next, there is ‘Rat appointee Anne M. Burke, who is known in Catholic charitable circles, whose husband, Alderman Burke from the 14th Ward, is supporting another candidate. So you would have 4 justices who would not necessarily be in Emanuel’s camp.

Emanuel’s stay request does have merit, as he would be “irreparably harmed” if his candidacy for mayor is terminated prior to election day. He can show likelihood of success on the merits by virtue of the dissenting opinion written at the intermediate appellate court level. Other candidates can’t really show that they are harmed, because there is a presumption that a candidate does not have a vested interest in another candidate’s disqualification from the ballot, and the public is served by having as many candidates to choose from as possible. Since Emanuel’s name can be stricken from the ballot later (or his votes not counted at all), it can be argued with a straight face that the public interest is served by granting a stay pending full briefing and argument.

Another theory. It is widely believed by “Chicago-ologists” that Ed Burke is the real power behind Chicago’s mayoral throne, and Ed Burke is backing Gery Chico. Chico is as liberal as they get. From his senate run in 2004:

The Economy: Chico’s biggest push for economic renewal is re-investment into infrastructure. He also wants a complete rollback of Bush’s tax cuts.

Healthcare: Chico supports single-payer, universal healthcare.

Education: Chico is very active in education, obviously, and feels his record in CPS is a good one (indeed, scores did improve each year under his watch). He opposed school vouchers and feels No Child Left Behind has been a dismal failure. His plan for education is remarkably sophisticated and imaginative. I can’t do it justice in this space; you really should go to his website and read the truncated version.

Foreign Policy/War on Terror: It is not clear how Chico felt about the invasion of Iraq, but his foreign policy stand is one that supports multi-lateralism and commitment to cooperation with the United Nations and other international regimes, such as the Kyoto Protocol. He has also issued a very in-depth policy paper on the PATRIOT Act and the conduct of Homeland Security in general. He really hates the PATRIOT Act, by the way.

Abortion: Chico is pro-choice.

Affirmative Action/Gay Marriage: Chico is a supporter of affirmative action, at least in principal. He has lobbied strongly for gay rights issues and supports protection for gay domestic partnerships.

Sooo, Chico is the Chicago candidate, Rahm is the Obama candidate, and Burke’s wife, Anne Burke, who sits on the Illinois SC, and who could be the swing vote, won’t recuse herself from the residency decision. Sounds to me like a gangsta war, with Obama trying to assert himself as being even more powerful than the Chicago machine that created him. Very interesting ....

BTW, another odd fact. The Chicago Tea Party istrying to drum up support for Chico, though he is anything but Tea Party material. I don’t get that. Not at all. Something’s not right ...

What’s amazing and sad is that it doesn’t matter if he’s in the ballot if no one votes for him. Chicago, what the hell is wrong with you!!!!!!!

Hey, if the POTUS does not have to be a U.S. citizen, why should a piddly little mayor have to be resident of that city?

I know. Just HAD to say it.
Not really a “birther,” but I am very suspicious of all of them and the things they are all hiding.

Chicagoan s need a grasp on reality and understand that such residency laws are intended for the serfs. The cops or firemen must obey and abide or lose their job. Rahm as Obama’s Chief of Staff and Democratic elitist is obviously quite special, and not of the same class that are most average Chicagoans.
