Seems a very aggressive and insular outfit in Indio is running some sort of fortified compound with walls 24 feet tall and four feet thick and they're suing anyone who dares to fly over or near their property.

When I spent a few months in Laguna Nigel the big news was one homeowner sueing someone building a house over a block away because his porch was blocking a few feet of his view of the Pacific. Seems only reasonable to prevent ballons from blocking their view of the clouds or stars.

It will be interesting to see where Freepers come down on this one.

Just like any other aircraft, balloons are required to fly above 500 feet (above ground level), except when taking off and landing. They also have to maintain 1000 feet over any obstacle within 2000 feet, horizontally.

As long as they are doing this, they are legal. "Property rights" don't include the air above you.

[Note: balloon festivals get a waiver of these rules, with certain pre-requisites]

They evidently have a lot of money for a lawyer. They are bankrupting people with legal fees or getting default court orders because people cannot afford to defend themselves.

Why would an honest judge reward these pukes?

When you start reading some of the local accounts in the Desert Sun this group starts to sound sort of whack-a-doodle. They spent the last ten years building a fortress, their attorney pulled his profile off of Findlaw today, and they’ve got all sorts of oddball maildrops for all of their corporate officers.

Regardless of their altitude you are responsible for anything your shot or bullets hits. Flying over a property does not justify lethal force.
