WisPolitics: Appeals court sends budget repair bill lawsuit to Supreme Court

A state appeals court says it found two cases that seem to back the Dane County DA’s position in the collective bargaining bill complaint and two that support the secretary of state’s argument.

The 4th District Court of Appeals wrote in its certification to the Supreme Court on the complaint that it would be appropriate for the justices to take the case because there are issues they would ultimately consider on petition for review anyway. Taking it up directly would “reduce the burden and expense of the appellate process on both the parties and the judicial system.”

Assembly Minority Leader Peter Barca, D-Kenosha, praised the appeals court move.

“It is good to see the courts are taking what I believe is a deliberate violation of the Open Meetings Law, on the part of Republican legislative leadership, very seriously -- as is our tradition in Wisconsin,” he said. “Our goal here is justice as well as transparency and openness in government. As our state Constitution underscores: The rights of the people of Wisconsin must always come first.”

Said DOJ spokesman Bill Cosh: “The decision whether to accept Certification, and upon which issues, is up to the State Supreme Court. We are awaiting an Order from that Court.”

Games continue in Madistan.

State senators have options, including passing the original bill and re-passing the collective bargaining bill, but they are pursuing the Appeal out of desire to maintain separation of powers and send the proper message back to the meddlesome county court judge.

Meanwhile Gov. Walker's staff is working on legislation pulling together the discarded pieces of his budget repair bill, including a restructuring of state debt. It is expected the pieces of the bill that were temporarily sidelined by the Flee Party escaping to Illinois will be taken up after the senate reconvenes on April 5.

If there is any justice, not only will the WI Supreme Court reverse the decision and support the Senate but the decision will be delivered in suitable form and with lubricant so that pain-in-the-ass Peter Barca can properly file it away.

Unless I’m wrong, I’ve read a liberal deciding vote is likely to be elected to this court in a week or two?

The Senate should immediately repass this bill as soon as it reconvenes don’t even wait for the Court.

Very important election coming up first week of April. Good guys hold a 4 - 3 edge on State supreme court. The libs are trying to tie the conservative judge to Scott Walker, our Governor. Lots of big union money running TV ads here against the conservative judge. Here's the kicker...The lib running against the seated judge has never been a judge! Hard to believe you can run for the highest court in the state and never have been a judge....welcome to Wisconsin, where we're taking our government back inch by inch!

It appears as though the knuckledragging, commie union thugs are winning. This is why I’ve always believed that EVERYBODY should be required to pay taxes. If you don’t pay taxes, you don’t vote.

When does the newly elected judge’s term begin? It probably won’t be immediately. Just don’t swear him in for a while and watch the RATs howl.

I hope that you're wrong. However, there is an election for state supreme court justice on April 15. The incumbent, Prosser, is probably favored, and leans conservative. The challenger, Kloppenburg is a liberal to be sure.

In the primary that was held in February, Prosser won with a comfortable lead:

105,002    24.99%    JOANNE F. KLOPPENBURG
231,017    54.99%    DAVID T. PROSSER JR

Fingers crossed from down here in FIB-land for that SC election! I guess it will be the first test of whether the true sentiment of WI is with the patriots or the unwashed unionst hippie pigs who trashed out the state Capitol. Not that I’m biased either way....
