Scalise says Obama violates Constitution over 'czars'
The Hill ^ | 4-16-11 | Erik Wasson

Posted on 04/16/2011 10:42:56 AM PDT by Justaham

Rep. Steve Scalise (R-La.), the chief sponsor of the effort to defund administration-appointed advisers known as "czars," reacted angrily Saturday to a signing statement from Obama saying he plans to keep them. In a statement emailed to The Hill, Scalise accused Obama of acting like a “dictator.”

"President Obama should know that it is the courts, not the executive branch, that has the authority to determine the constitutionality of laws passed by Congress, especially considering that he agreed to this provision and signed the law himself," Scalise said in an emailed statement.

"The President does not have the option of choosing which laws he will follow and which he will ignore,” he continued.

Scalise said that Obama's backtracking on the czar issue will make future talks on spending and the budget more difficult.

“The president knew that the czar amendment was part of the overall budget deal he agreed to, and if he cannot be trusted to keep his word on this, then how can he be trusted as we negotiate on larger issues like federal spending and the economy,” he said.

“A bipartisan coalition in Congress agreed that President Obama was circumventing the constitution by appointing these czars without the scrutiny of Senate confirmation. The United States is not a kingdom run by a political dictator, and President Obama needs to quickly reverse course and abide by the law eliminating the czars that were part of the budget resolution agreed to by Speaker Boehner, Senator Reid, and President Obama himself,” Scalise continued.

The boy seems to be asking to be impeached. Maybe he thinks, Hey! It worked for Slick Willie!

So I ask once again what are the tools the House has as stand alone to enforce agreements with this out of control, arrogant POTUS?

Here we see one tool is to talk angrily.

I believe Obama violates the constitution just by being President.

Expect more actions like this from Obama until 2012. He knows that he owns the GOP leadership after this week. He will dance around the edges of legality, knowing that he’s irritating his opponents, and that they will grumble to themselves and do nothing about it.

I think he almost wants impeachment talk- knowing that it helped resuscitate Clinton thanks to the MSM, just as he believed that a shutdown would work in his favor. (But for many reason, he’s no Clinton).

Art II Sec 2 makes it clear that if the President appoints such “counselors” they must be lower than the department heads that are confirmed by the Senate.

In Obama’s administration, the czars are superior to the department heads. That’s the constitutional problem.

Come on, give the guy some credit for calling (.)bama out on this. He is following the Trump example...take him on because he is a coward and cannot stand up to a face to face fight. That is his makeup, he does nothing directly unless he is in the control position.

I wish that Ryan would have stood up during the speech last week, aimed directly at him as an in your face assault, and called him out directly. In fact, he should have mooned him.

Hey I am for him. Heck at least he is not just another talking point bozo. I think he will lively it up. The Conservatives are thinking it is a trap. I just remember a few years ago when he had a big battle with Palm Beach about his big American Flag he would not take down.

"President Obama should know that it is the courts, not the executive branch, that has the authority to determine the constitutionality of laws passed by Congress, especially considering that he agreed to this provision and signed the law himself," Scalise said in an emailed statement.

Of course the idiocy of this statement is one of the main reasons we are where we are. Certainly the President has the right to determine the constitutionality of laws. He has the absolute right to veto measures he believes are unconstitutional and more importantly he has the right to prevent the executive branch from enforcing laws he believes are unconstitutional.

It's just been so long since we had a President who gave a rip about the constitution that no one remembers this critical component of the constitution. Checks and balances. There is nothing in the constitution that says the judicial branch is the sole determiner of what is or is not constitutional.

Scalise is part of the problem not the solution. Now clearly in this case obama lied. The appropriate response is to call him a liar, even to his face. The appropriate response is not to misinterpret the constitution.

Impeachment without removal is only a strong censure, but if serious impeachment hearings were held, the subject of his foreign birth would inevitably be brought up. Maybe we can force him to sow his COLB or fold.

“In Obama’s administration, the czars are superior to the department heads. That’s the constitutional problem.”

Meanwhile, the Courts and Congress allow him to continually crap on the Constitution without any consequence. Like all tyrants, he will keep on expanding his power knowing that no one in government has the courage to challenge him.

Scalise could, perhaps, use some of that vitriol to file impeachment papers, no?

Totalitarian Marxists of the sort now taking flight in America know nothing and care even less for the Constitution.

We must stand up and fight against these Rulers or accept becoming subjects to of the State.
