SWAT: We said, 'Open up' at least twice
Arizona Daily Star ^ | 6/4/2011 | Jamar Younger

The SWAT officers who shot and killed a man while serving a search warrant last month gave at least two commands for someone to open the door before knocking it open, according to documents released Friday.

The officers told investigators that, upon opening the door, they saw a man appear in the hallway holding a rifle before they saw what they thought were muzzle flashes from his gun.

It was later determined Jose Guerena's rifle was on safety and he didn't fire at the officers.

The Pima County Sheriff's Department released hundreds of evidence photos and transcribed interviews with the SWAT officers who fired at Guerena during the raid on his home May 5.

The photos show the interior of Guerena's home - its walls painted a dark gray - and evidence collected at his home and three others searched that day. The photos show guns, ammunition, vehicles, cash, documents, cellphones and other items found at the homes or in the vehicles.

Lying is an essential function of our police state.

Lying is like being cut by a knive, it will heal, but it will also leave a scar.

Wow “guns, ammunition, vehicles, cash, documents, cellphones and other items”.

Really. I wonder what dastardly category that 'other items' fit into.

All one has to do is watch the video to realize there is no possible way that any person could have had time to "open up." What good asking someone to "open up" if you're going to smash the door in without giving him time to comply with the order?

Gee, they found vehicles and cell phones! The other day I heard they found "banking documents."

These scum - who are in full CYA mode after outraging the entire country - should be fired, jailed then executed like the low-life killers they are.

“It took at least a minute to issue the commands before they knocked down the door, he [Deputy Walsh] said.”

Wow “guns, ammunition, vehicles, cash, documents, cellphones and other items”. That would make 99% of Freepers worthy of a swat raid.

It’s worse than that. Most freepers would recognize the name Randy Weaver. That would get you shot upon questioning.

Keystone Cops...unprofessional, amateurish.

They all should be facing manslaughter charges and the person in charge something even worse.

Would have been nice to identify themselves as cops.

That would be false advertising. These little girls are nothing more than thugs that Stalin and Obama would be proud of.

The officer who yelled out the commands to open the door said it took at least a minute to give the commands in English and Spanish twice and part way through the third time before they smashed open the front door.

That seems at variance with the video they released last week.

They claim they said "Open up" twice? The video tells a completely different story.

I’m more than a little certain that there are at least 10 cellphones lying around my house. Right now I’m using my daughter’s phone because I didn’t have time to get a new one before a trip when mine went south on me last week. The bottomline, which will be avoided at all costs here, is that it doesn’t matter much if Jose was guilty of... something, or not; he was innocent in the eyes of the law and therefore his protection should be a consideration when you have determined that it is necessary to enter his home UNANNOUNCED with guns drawn and safeties off. I am now officially for the decriminalization of all drugs at the federal level. We have lost our soul.

They should be tried for murder. Because of the corruption there, however, they will be excused.

God will judge them.

With hundreds, if not thousands of instances like this one, why do we continue to allow these goons to operate, in this jackbooted manner?

Hostage situation, fine. Send in SWAT.

On 48 hours, a reality cop show, more often than not, the detectives looking for a murder suspect, simply go knock on the door. “Is Antwon here? Do you know where we can find him?”

From where I sit, it’s beginning to look like SWAT teams are a strong armed enforcement body, with a license to kill, serving at the beck and call of corrupt politician/s.

ZOMG! Vehicles and cell phones!

Some of my neighbors have "vehicles" and "cell phones". Should I inform on them?

Honest, hard-working, freedom-loving people must acknowledge that the Constitution is in place to protect the guilty as well as the innocent. Suppose the police had discovered a small stash of drugs in a coat pocket? Does that excuse the action? In the minds of many here I’m sorely afraid that it would. We are becoming a police state.

That siren right outside the door was probably all the real warning the man had., The knock on the door was just plain
funny. My Grandmother could knock louder than that.Let’s say it was perfunctory, if there was a shout it was also perfunctory and not meant for anyone inide to hear. A CYA move before the shooting started.Once a weapon was fired they went nutso, just ran for the door and emptied their weapons.

Think about it.

You are minding your own business at home (maybe in the backroom) and you hear someone pounding on the front door and maybe or maybe not you hear someone yelling open up.

Is your first reaction to rush to the door to open it?

Of course not, your first reacton is to pause try to figure out what is going on, possibly arm yourself or at the very least carefully and slowly look out the window or something.

But of couse that’s probably because we are all guilty of having more than one cell phone, cash, vehicles and maybe horror of horrors... grey walls!!!
