A Texas woman was sentenced to five years probation after pleading guilty to the charge of Injury of a Child. What did this Corpus Christi mother of three do? She spanked her then nearly 2-year-old daughter.
"You don't spank children today," said Judge Jose Longoria. "In the old days, maybe we got spanked, but there was a different quarrel. You don't spank children."

My mother used to use a wooden paddle or the end of a metal fly swatter on our rear ends when my brothers and I deserved it. Over our formative years we pulled some doozies!
I have thanked her countless times since then and I would like to believe being punished when I deserved it has made me a better person.

I think this is the part that is overlooked by people. Since this story broke, the prosecutor released via email a statement that more completely described the events of the plea agreement. Apparently, the medical evidence demonstrated convincingly that their were bruises on the child's lower back and bottom. I don't know how anyone can say that bruising a child (a child who isn't even yet two) isn't abuse. Of course it's abuse.
As for the judges editorial comments - they were just that - editorial comments at sentencing. Judges, especially municipal and county judges (those that are elected) say all kinds of stupid things at sentencing. Those comments don't have any legal consequence. It's just the editorial (not legal) opinion of the bench.

The state has put Gonzales's three children in the hands of the [paternal ?] grandmother.
Hmmmm. Seems to me like the mother-in-law had an agenda here.

This judge needs to be tarred and feathered and run out of town on a rail with a noose around his neck.
About leaving red marks? So what. That is an artificial line drawn by those who have an agenda, and by those who want things cut and dried so they're easy to sort out without thinking it through.
In my school days I got plenty of red marks from teachers. And when I got home I got red marks from my Dad for getting in trouble at school.

That's not an omnibus beat your children verse, but it does point to the fact that without discipline - sometimes severe - you have not loved them. Just the opposite you have let them grow in self will. When we consider the potential for greater crimes and greater punishment in this life ... and when we think of the next and the condemnation that awaits the unsaved - so great in fact that Jesus said you would be better off had a millstone been tied to your neck and you then been thrown into the ocean - and that passage in particular was directed at those who offend His little ones: that gives poignancy to Proverbs 13:24, ... hating your children is an offense to God. We all fall short, it's difficult at best and a judiciary like ours makes it very difficult.

When my kids abused my rules, I abused their butts, yep there were red marks on occasion...
Wife took care of minor infractions, I took care of major items...
Judges in Texas are elected. The surprising thing I found for Houston, even for a Democrat town, Republican judges still got elected. And some good ones as well. But that was in the 90’s.
So yes, the Tea Party should review the records of judicial candidates.
Unfortunately my office is in Corpus Christi. I moved to the lake to get away from living near idiots like this. It’s worth the long daily drive.

I’ll trust the Good Book’s “Spare the rod and spoil the child” dictum before I ever listen to some judge in ANY temporal courtroom.

I don’t see all the failure on the judge’s part. I disagree with his ruling, but for things to reach him...
1) Someone had to report this spanking ‘incident.’
2) Police or CPS investigated and referred the case to the DA.
3) The DA filed charges...
For one stupid ruling to have been made, at least three other idiots made worse decisions. The decision to report the punishment of a child, the decision that such punishment was so egregious that it needed to go to the DA, and finally, the DA for deciding this was a significant enough crime to file charges against the woman.
Sure, throw out the judge, but there’s a bunch more that need a much more critical eye. Especially the DA who decided to press this case - and I hope parents out there are eager to demonstrate just what their opinion of this overreach is come next election.
