Woman to serve 15 days for choking Walmart greeter
The Chronicle Telgram (Elyria, Ohio) ^ | September 30th, 2011 | Steve Fogarty

A woman who choked a 71-year-old greeter at the Elyria Walmart Supercenter and then boasted about it to her daughter was sentenced to 15 days in jail Thursday in Elyria Municipal Court.

Judge Lisa Locke-Graves, who imposed the sentence against Toni Duncan, 49, called the attack “absolutely reprehensible.’’ Duncan had pleaded no contest and was found guilty of assault earlier this week.

“I am appalled that someone would choke a person 71 years of age,” Locke-Graves said.

In the March 30 incident, prosecutors said Duncan choked Alger Burchell when he asked to see a receipt for her purchases.

Locke-Graves sentenced Duncan to 120 days in jail but suspended 105 days. She ordered Duncan to be taken from the courtroom to immediately begin serving a 15-day jail sentence. She cited prior delays in the case and continuances in denying attorney James Kersey’s request for more time before Duncan reported to the county jail.

Duncan also was ordered to pay court costs, take an anger management course before the end of the year and not to have any criminal violations for five years. She was further ordered to stay away from Walmart and Burchell for five years.

Duncan’s daughter, Ashley Jackson, 23, was sentenced to 30 days in jail and fined $250 for disorderly conduct, but Locke-Graves suspended 27 days of the jail time for three days’ community service with the Elyria Streets or parks departments. The judge ordered the community service to be served by Nov. 30.

“I expect you to be capable of doing the work and having the proper attitude,” Locke-Graves told Jackson.

Jackson was also ordered to maintain five years of good behavior, take an anger management class and stay away from Walmart for five years.

You say,
He had no right to do that.

and she said,
Had bragged to her daughter that she had "just choked a cracker".

and I say,
This lady was an accident just looking for a place to happen, it just happened to him that day...

Why isn't this a hate crime?

Can you imagine if the she was white and the greeter was black, and she bragged to her daughter that she had just choked a n.....

what a different story that would have been.

With net margins of 1-2% theft can eat up profit in a hurry. Checking receipts undoubtedly deters enough theft to make the expense worthwhile.

It is Wal-Marts property they are standing on. Wal-Mart has rights too. There are thieves who target them. Their store policy is to make checks to see if their property isn’t mixed in with your property. Best Buy does this as well. If you don’t like their policy then you are free to take your business elsewhere.

Not all 71 years olds are like this guy/

I am 69, I don’t work at Walmarts as a greeter, but if a fat walrus like this choked me she would be picking her fat ass up off the floor.

The checking of receipts is not really aimed at shoplifting. It’s aimed at the customer and the checkout person being in cahoots, by not ringing up one or more expensive items. In many cases the door checker is merely being sure the item counts match. If it’s a big item like a TV or computer, they will check to be sure the right item has been rung up, and not something cheaper.

Then you would end up in jail, Wal-mart sued, she’d be a millionaire AND you would lose your job.

I noticed she didn’t mind having a white guy as her attorney.

That proves she’s a racist, but not a stupid racist.

Common folks, fess up. Haven’t we all met someone in a retail store that we wanted to choke the living daylights out of?

I know I have.

“I guess if the chokee had been 41, the judge wouldn’t have been appalled. But 71? That’s appalling.”

If the chokee had been 41, the perp probably wouldn’t have tried, or would have gotten her ass handed to her. Even thugs know how to figure odds most of the time.

for some perverse reason I find this pretty funny.

although I’n sure it wasn’t so funny for the greeter.

Asking to see receipts when people leave is highly offensive. They know this, but they choose to continue the policy anyway.

I gladly show my receipt at Walmart as I am leaving, even when I am not asked.

The greeters have a thankless and sometimes hostile job. Why can't I be someone who doesn't mind making their life easier, if only just for 5 seconds.

Dealing with the public I’ve met my share of folks I would not mind making a snide remark to, but I would always leave the violence to them... so they could do the time for the crime. :-)

The only thing I can say is that in Louisiana or just about any Southern state they each would be doing a lot more time.

Agreed. 15 days for assault when she had priors? The judge was too lenient.

The only stores I shop at that do this are Walmart and Sam’s. There may be other stores that do it, but haven’t seen it in any other store in my area. I have to believe if it was necessary more stores would be doing it. I do understand shoplifting is a major problem- I just don’t think this is the right solution. I think it is a way for Walmart to save on hiring adequate security. The only security I see at my local Walmart is an old drunk that was fired from LEO years ago for being a drunk. I am pretty sure he would be worthless in a serious incident. If their own employees are an issue then they need to re-think their hiring practices.

Both Best Buy and Fry’s Electronics do it too. I’ve seen many others do it, usually around the holidays.

If you are at a very large Superwalmart, it would be really easy for someone to remove the security tag and push expensive electronics in a cart right out the door. Any other items in the cart too. The Greeters may not be security, but it gives them something to do and tells the shopper if you're trying to steal something, be forewarned we're going to check.

My daughter's friend works in a large 24 hour grocery store and people regularly fill up a cart and try to take off. At night when there's only a few working and 20 lanes to sneak through, security is difficult.

The cart belongs to the store and is provided as a courtesy. She is not obligated to use the cart. So long as she is on the property and using Walmart equipment, she can be asked to demonstrate lawful possession
