There’s precedent: “You’ve got to pass it to see what’s in it.”
It’s troubling that they think so little of the constitution that they think they can legislate it away, but I don’t think the clause would hold up in court.
I’m not sure even the screaming liberal side of the USSC would buy this attempt to trump the 11th amendment.
And as for the tax penalty or whatever for offering a job to a person already having another job — did anybody think through unintended consequences? This sounds like something a middle schooler who thinks he’s bright might think up. This will discourage firms that move from offering new positions to the people working at the sites being vacated. Also it will discourage promotions even if they result in a vacancy that the company fully intends to fill.
