I get your point, but you’re missing my point. Securities fraud is a crime, but the SEC will prosecute it half the time in a civil proceeding. Does that mean a firm found guilty of civil securities fraud didn’t break the law? Breaking the law is a crime, civil or criminal. Election law gets prosecuted in civil court. Does that mean a congressman stealing campaign cash from his campaign didn’t commit a crime? Yes he committed a crime. But he’ll most likely face a fine. Sexual harassment is a crime, even if it’s handled in a federal civil court.

A crime is an act that is in violation of the law where a punishment is imposed once one is found guilty.

Your mistake is thinking that sexual harassment is a federal crime. It’s not. There are no common law federal crimes.

Securities fraud is a federal crime and also a civil violation.
