Appeals court upholds Obama’s health care law

A federal appeals court on Tuesday upheld a controversial requirement for Americans to purchase health insurance, becoming the sixth appeals court to rule on challenges to President Obama’s health care law that are likely headed to the Supreme Court next year.

In a split opinion, a three-judge panel for the U.S. Circuit Court of Appeals for the District of Columbia said that the centerpiece of the health care law — a mandate for individuals to buy health insurance or pay a fine — was an encroachment on individual liberty, but no more so than requiring businesses to serve all customers regardless of race.

“The right to be free from federal regulation is not absolute, and yields to the imperative that Congress be free to forge national solutions to national problems, no matter how local — or seemingly passive — their individual origins,” wrote Judge Laurence H. Silberman.

While most rulings over the Affordable Care Act have split down party lines, with Republican-appointed judges generally opposing the individual mandate and Democrat-appointed judges generally favoring it, Judge Silberman was appointed by President Reagan. Concurring Judge Harry T. Edwards was appointed by President Carter....

They already make us pay taxes for nothing.

They can make us do whatever they want when idiot judges like Silberman (appointed by Reagan) tell us the federal government is all-powerful and can make us buy whatever they want us to.

Seriously? That’s the best comparison they could come up with? First of all, businesses have to serve all customers because there’s specific Constitutional language against undue racial discrimination. There is no such language in favor of universal healthcare. And more to the point, when businesses serve a customer, they MAKE money!

So the Federal government can violate the US Constitution as long as it’s for a good cause?

It should be illegal to appoint a democrat to a judgeship..
The Clintoons and Obama have slimed the justice system badly..

Short of a Civil War it will not change..
Half the country are malefators..

“We” may have a federal government that exactly matches “the people”..

What a twisted piece of logic. It is definitely a limit on freedom to require a business to serve all customers. But there is a major difference. The business owner chose to go into business. He is not being forced to do something just because he exists in the “most free country of the world.”

Also, the business owner is not required to serve disruptive customers or those who are chasing off their other customers. And they are only required to serve customers who pay their price. They are not required to serve people for free. So their logic is twisted.

How is Health Care a “National” problem? Because they got their foot in the door with Medicare and Medicaid; should have been fought more vigorously back then.

When the Jack Booted Thug (aka JBT) makes you buy insurance at the point of a gun...the Government makes money! And that's all this is about.

It appears that there are a LOT of federal judges that need to be removed!

I still don't understand how 200 million people can be "required" to buy anything, particularly if 0bama and his goons keep destroying the economy so they don't have the money to buy it even if they wanted to.

Yeah so sad. I hate to go the way of Canada, Australia and Israel, with their disgusting socialized medicine. I know Israel is a great nation Biblically and I obviously support her, but it can be tough when you read about their health care system. Is that really what God wants? Wish I had the theology background to say...
