Tennessee speed guns: Payback vow on NYers for 9/11 Memorial bust
NY Post ^ | January 20, 2012 | LAURA ITALIANO

Gun nuts in the Tennessee state legislature have declared civil war on New Yorkers — saying they will retaliate for the prosecution of a woman who was carrying an illegal pistol at the 9/11 Memorial. A resolution winding its way through the Tennessee legislature warns New Yorkers not to drive through their state — because the Highway Patrol is “gunning” for us. A Knoxville-based legislator, who moonlights as a farmer, is so angry over the Tennessee tourist’s gun arrest last month that his resolution condemns it as a “grave miscarriage of justice” — and reminds New Yorkers to “drive carefully” if we come visit.

“We remind the citizens of New York, especially those residing in New York City, to drive carefully through the great state of Tennessee, paying extra attention to our speed limits,” reads House Resolution 585, which urges charges be dropped against Meredith Graves. A registered nurse and fourth-year medical student, Graves was arrested when she tried to check her Tennessee-registered weapon at the 9/11 Memorial in December. It’s illegal to carry the weapon in this state. Graves faces a mandatory minimum prison sentence of 3 1/2 years if convicted of felony weapons possession; prosecutors have not said if they will seek an indictment on that or on a lesser charge.

You do realize that that “fubo” sticker on the back of your car was thought up and sold by a “New Yawker”, right?

Maybe you had better pull it off, since all people from New York are the same and you sure don’t want anyone to think you agree with a “New Yawker”. It might get you pulled over on a BS “speeding” charge.

BTW: We pronounce our R’s where I come from. You say “Yawk” for “York”? Man, you people sure talk funny.

I agree with your position re:"reciprocity."
My concern is how this announcement will be interpreted by the Bubbas w/a badge 'n a bubblegum machine on their roof.

Maybe it will divert them from their Korean Massage Parlor time.
(inside joke...but true)

I don’t buy the argument that the rest of new York are blameless.

An excellent point. Just about the time I am ready to give up on FR because it is just a place that many ( like me ) come to vent their frustrations someone like you thinks things though.

Conceal Carry Permits are issued by the state. Some states tell the cities that they WILL NOT go beyond state laws.

I think Florida, Pennsylvania, Nebraska, Virginia and many others tell the cities this is state law, do it our way.

Chicago and NYC do it their way. Chicago even goes so far as to control the rest of the state. Washington DC is special, they just spit on The Constitution.

Here in Missouri the cities of St Louis and Kansas City used a technicality to drag their feet for up to 14 months after citizens in the remainder of the state were issued permits.

LEOs are human just like you and I. If they make a traffic stop they run the license plate before they ever get out of their car. When the report comes back to them it gives name and address of the vehicle owner. Once they get out of their car their life is on the line as well as their personal feelings, good or bad.

Reciprocity, or the lack of it causes confusion as well ill will. That said there is one thing to keep in mind, Concealed Carry Permits started and continue today from actions taken at the state level.

What have our federal public servants done to enable you and I to protect ourselves, our families, our property? Very little, if anything positive.

States Rights have brought us Conceal Carry Permits. If there are disagreements, revenge, tick for tack among the states so be it. It is far from perfect, but better than being faced with going barehanded into a gun fight.

Again excellent point, you caused me and hopefully others to think about self protection as it is today across this great country.

Archy, isn’t there a law with severe penalties for infringing on civil rights under the color of law?

Indeed; there aere, in fact, two federal civil rights statutes that apply. First, the one that as you note, involves civil rights infringements under color of law:

Title 18 United States Code, U.S. Criminal Code, Part I, Chapter 13, §ection 242:

Deprivation of rights under color of law

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Also:

Title 18 United States Code, U.S. Criminal Code, Part I, Chapter 13, §ection 241:

Conspiracy against rights

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

I believe it's because of these provisions in federal law that Justice Department personnell have stated that they intend to plead the Fifth amendment regarding testimony relating to the death of CBP Agent Brian Terry.

We have seen a former U.S. Attorney General jailed for his misdeeds [Nixon Administration A.G. John Mitchell/Watergate] but we have never had one jailed for life or put to death.

Yet.

Wait until Laura finds out about the proposed Wyoming and Montana legislation that would give state and county police in those states the legal authority to arrest those from states that fail to recognize Wyoming or Montana concealed weapons licenses for failing to have a valid driver's license, those drivers licenses from states which fail to recognize our state's documentation thereby to receive reciprocal treatment.

Oh, and their counterfeit license plates? Grounds for their vehicles to be impounded and crushed in mobile carcrushers on the spot.

Enjoy your visit to Yellowstone, you New York racists.

Indeed, if New York is going to hit Tennesseans with unjust treatment. Tennesseans aut to hit them right back.

Retropositiy is a two way street, and if New York wont honor the documents of Tennessee. Tennessee aut to take a serous look at New Yorkers and their documents in Tennessee.

Likewise Tennesseans aut to treat New Yorkers with the same level of respect New Yorkers treat Tennesseans in the carrying out of their law enforcement.

New York should not be allowed to miss treat the citizens of other states with impunity. It is the responsibility of Tennessee to assert her rights and make New York respect them.

See Post # 107. BTW, In Wyoming, we've had *free carry* since July of last year: carry whatever you loke, openly or concealed, no permit or license required.

Montana is working on it, but they have a Democrat governor in the way [the first Democratic Governor in Montana in 20 years] and need to remove and replace him first.

If it is proven that gunwalker & fast and furious were part of a plan to undermine the second amendment. I can see these laws coming into play.

Ahahah now that’s one upmanship and Wyoming don’t even have one of their own being held Hostage to the New York injustice to rally behind.
