Gloria Allred has sent a letter to Denise Nieman, the County Prosecutor in West Palm Beach, Florida, on behalf of the Women’s Equal Rights Legal Defense and Education Fund, asking for an investigation into whether Rush Limbaugh violated Florida defamation law when he called Sandra Fluke a "slut" and a "prostitute." Allred cites Section 836.04 of Florida Statute, which says that "whoever speaks of and concerning any woman, married or unmarried, falsely and maliciously imputing to her a want of chastity, shall be guilty of a misdemeanor of the first degree."

Gloria Allred has no standing in this case. It would be up to the “victim” to contact the prosecutor and file the necessary police report, then the prosecutor may, at his discretion determine if a crime has been committed.

No publicly elected prosecutor is going to file charges against Limbaugh and then have to explain to an electorate why resources are being used to prosecute a misdemeanor of this type. Besides....could you imagine the number of women who would gather in the prosecutor’s office on a Monday morning after their boyfriend’s ‘dissed them on a Saturday night?

This is nothing more than another “look at me” moment for Allred.

I would submit that unless Fluke is her client, she should shut her yap. It may very well be that Sandra DOES have counsel and Gloria may have to answer to the bar about her interference with Sandra’s true counsel.

This is much ado about nothing.
